Your right under Article 10 of Regulation 1049/2001 to receive the
information in electronic form is respected, as you will receive the reply
to your request for access to documents in electronic form in addition to
paper form.
 
The decision to ask for a postal address from applicants for access to
documents was triggered by i.e. the following consideration:
 
The need to obtain legal certainty as regards the date of receipt of the
reply by the applicant under Regulation 1049/2001. Indeed, as foreseen by
Article 297 of the Treaty on the Functioning of the European Union (TFEU),
[…] decisions which specify to whom they are addressed, shall be notified
to those to whom they are addressed and shall take effect upon such
notification. Replies triggering the possibility for administrative or
judicial redress are therefore transmitted via registered mail with
acknowledgement of receipt. This requires an indication of a valid postal
address by the applicant;
 
We therefore kindly reiterate our request to you to provide a full postal
address, so we can duly register and handle your request. Please note
that, once we receive your postal address, we will register your request
for access as an initial application for access to documents in the
meaning of Article 6(1) of Regulation 1049/2001. The deadline for handling
your initial request shall run as from the moment of registration of your
request following the submission of your postal address.

Given that Article 7 of Regulation 1049/2001 states that applications are to be handled "promptly"; that you have already confirmed receiving my application on October 18th; and that you yourself have argued the legal necessity of providing a postal address only for the purpose of the transmission of "replies triggering the possibility for administrative or judicial redress", not for the registration of my application on your end; I will continue to assume that my application has been registered on October 18th and I will receive a reply to my application by November 8th.

I am filing the following confirmatory application with regards to my access to documents request 'Flash Cards used to explain Trade Policy to President Trump'.

You have refused my application claiming that granting me access would „undermine the protection of the EU public interest concerning international relations, in this case specifically the relations with the United States of America.“ However, it is my understanding that the documents in question contain only general explanations of trade policy rather than any information that would be considered confidential by either the EU or the US government. I therefore fail to see how relations could be harmed by making them accessible to me and would ask you to reconsider my request.

Your confirmatory application is currently being handled. Unfortunately,
we have not yet been able to gather all the elements we need to carry out
a full analysis of your request, in order to take a final decision and,
therefore, we are not in a position to reply to your confirmatory request
within the prescribed time limit expiring on 22 November 2018.

 

Consequently, we have to extend this period by another 15 working days in
accordance with Article 8(2) of Regulation 1049/2001. The new deadline
expires on 13 December 2018.
