Under the right of access to documents in the EU treaties, as developed in Regulation 1049/2001, I am requesting documents which contain the following information:

1) a list of meetings and correspondences that Commissioner Moscovici, members of his cabinet or representatives of DG TAXUD had between March 2013 and today with business representatives insofar as these Meetings / correspondences related to the rules of origin verification procedures (ARTICLE 3.21 in chapter 3 on "Rules of origin and origin procedures") in the EU-Japan trade agreement;

2) minutes and any other reports of these Meetings.

We refer to your request dated 9 October 2018 in which you make a request for access to documents, registered on 9 October 2018 under the above mentioned reference number.

Your application is currently being handled. However, we will not be in a position to complete the handling of your application which expires on 30 October 2018.

An extended time limit for more in-depth investigations is needed in order to complete our assessment on the possibility for the public disclosure of the documents requested.

Therefore, we have to extend the time limit in accordance with Article 7(3) of Regulation (EC) No 1049/2001 regarding public access to documents. The new time limit expires on 22 November 2018.

Please pass this on to the person who reviews confirmatory applications.

I am filing the following confirmatory application with regards to my access to documents request 'Follow-up request: Rules of origin verification in the EU-Japan trade agreement - meetings DG TAXUD with business'.

I am astonished that the Commission services were not able to recover any documents in the requested context. Apparently, the RoO verification procedures have been under discussion for quite a while given the fact that Japan was mentioned by a DG Trade representative in this context already at the 27. Europäischer Zollrechtstag in Innsbruck, Austria in June 2015 (http://efa-muenster.de/images/efa_dokume.... If the meeting documentation by the association and participants is any guide (e.g. EFA Schriftenreihe Band 57, Mendel Verlag), this topic caused some discussion among the participants (which were btw from business background). It will come as a surprise to me if this has been the only occassion this issue was discussed and that apparently and that there has been no internal reporting back on discussions held.

Hence I kindly request to review the efforts undertaken so far.

confirmatory application in accordance with Article 7(2) of Regulation
(EC) No 1049/2001 regarding public access to European Parliament, Council
and Commission documents (‘Regulation 1049/2001’).

I also refer to our holding reply of 13 December 2018, by which the time
limit for replying to your confirmatory application was extended by 15
working days, pursuant to Article 8(2) of Regulation 1049/2001. This
extended time limit expires on 11 January 2019.

I regret to have to inform you that we will not be able to respond within
the extended time-limit, as we have not yet finalised ongoing
consultations. I can assure you that we are doing our utmost to provide
you with a final reply as soon as possible.

I regret this additional delay and sincerely apologise for any
inconvenience this may cause.
