Frontex and Member States return operations

Response to this request is long overdue. By law, under all circumstances, European Border and Coast Guard Agency should have responded by now (details). You can complain by requesting an internal review.

Dear European Border and Coast Guard Agency,

Under the right of access to documents in the EU treaties, as developed in Regulation 1049/2001, I am requesting documents which contain the following information:

1) Data on Joint Return Operations (JROs) coordinated by Frontex since 2005.

I would like the detail of the date, country and airport of departure of each flight; the host country/countries and the participating countries; the destination airport and country; the airline company which provided each flight; the cost of each flight, and whether the flights were forced return operations or voluntaries.

Also, I would like the detail of the number of persons returned in each flight, and among them, the number of persons returned because their claim for asylum was denied; the number of persons returned because they stayed longer in the EU than the period allowed by their visa, and the number of people returned because a criminal law sanction.

2) The same data on return operations organised individually by Member States since 2005.

3) The same data on collecting return operations organised by the non-EU country of destination since they started.

Finally, I would like to receive the information preferably as an Excel spreadsheet.

If this means of identification is not available to you

-Alternatively, for
natural persons: please provide an ID card/passport/residence permit in the EU
legal persons: kindly submit the registration of your entity in a EU Member State and a proxy authorizing you to act on behalf of this entity.
If you do not agree to submit documents containing personal data, we are unfortunately not able to process your application.

After receiving proof of your identity/proxy, we start processing your application and revert back to you within 15 working days.

Please be informed that:
•the person responsible for controlling your personal data (Data controller) is the Head of the Transparency Office
•personal data is collected for the exclusive purpose of assessing the nationality/proxy of the applicant and the seat of the entity represented by the applicant
•only members of the Transparency Office have an insight into your data
•your data is deleted at the latest when you receive the final reply. The public access to documents process does not take longer than 15 or 30 working days depending on the number/size of the requested documents
•you are entitled to access and rectify your data during the processing of your application
•during any steps of the process, you have the right to have recourse to the European Data Protection Supervisor

After receiving the above mentioned documents and your kind indication regarding the focus of your request, we will be able to start processing and will get back to you within 15 working days.
