FRONTEX paid charter-deportations from Germany

Response to this request is long overdue. By law, under all circumstances, European Border and Coast Guard Agency should have responded by now (details). You can complain by requesting an internal review.

Dear European Border and Coast Guard Agency,

Under the right of access to documents in the EU treaties, as developed in Regulation 1049/2001, I am requesting documents which contain the following information:

- List of all FRONTEX-paid charter-deportations from Germany in the time period between 01.01.2020 until 31.06.2021
> indicate for each flight: "destination country / countries", "departure airport in Germany", "exact day of flight", "number of people deported", "name of airline company used", "cost of flight"

- Describe according to which system it is chosen which airline gets hired for which charter-deportation flight:
> are the contracts on a "per flight basis"? Or are there long-term contracts with certain airlines?
> is there a charterflight booking system used to find the charterairline for deportation flights?
> is there an external company hired to arrange the bookings of charter-planes for deportations? If so, which company or companies are contracted for this?
> are there charter-airlines who have declared they are not available for deportations? If so, which ones?

- If a Frontex-paid charter-deportation breaks international laws, who can legally be held accountable: is it FRONTEX who paid for the flight or the nation who organised the flight?
> are there destination countries to which FRONTEX does not pay deportation flights? According to which criteria?

- What is FRONTEX's yearly budget for charter-deportations in 2018, 2019 and 2020? How much of this goes to Germany each year?

clarifications:

- If a Frontex-paid charter-deportation breaks international laws, who can
legally be held accountable: is it FRONTEX who paid for the flight or the
nation who organised the flight?

> are there destination countries to which FRONTEX does not pay
deportation flights? According to which criteria?

Could you please specify the question? What kind of breach do you have in
mind? To which international law are you referring?
