As you can see, I provided my postal address long ago. But now I see why you play tricks not to hand out the emails. Robert-Jan Smits has now publicly accused me of spreading "below the belt accusations" about him and Frontiers CEO Kamila Markram, at APE 2019 conference.

I am filing the following confirmatory application with regards to my access to documents request 'Full and uncensored access to emails between Robert-Jan Smits and Frontiers'.

My request for uncensored emails was rejected, despite EU Commission admitting that Frontiers did act as RJ Smits' advisor on OA transformation and Plan S, on the grounds that this consultation was
“part of a broad engagement with key stakeholders over the spring 2018”.

The argument makes no sense, and here is why.
1. Plan S was first hinted by RJ Smits at panel discussion on 11 July 2018, where also K. Markram was present. Plan S was then revealed on 4 September 2018 in PLOS and Frontiers. Until then, nobody was ever aware that there was any broad engagement with any stakeholders going on. The broad engagement began actually in fall-winter 2018, and concluded only this last week.
2. Of course it is possible RJ Smits solicited other opinions, from other publishers. Yet he did so in secret, carefully deciding whose opinions he will seek. Importantly, no scientists or their publishing societies were heard, this fact was established as soon as Plan S was announced. RJ Smits also admitted it himself at APE 2019 conference in Berlin. A secret consultation on science policies which excludes the only stakeholders which matter (scientists) but engages those commercial entities which directly profit from the proposed policies, cannot be ethical or even legal. Hence there is no right to privacy or business interest protection for what is possibly illegal lobbyism or misconduct in office.
3. RJ Smits asserted before that he designed Plan S alone, only with support from his personal assistant and Science Europe. I have this information first-hand. The new version (that commercial publishers were involved after all) does not fit and only proves that someone was not telling the truth.

in short, EU scientists and general public have the right to know who and why influences European research policies, especially such constricting and controversial ones like Plan S.

2019/152. The scope of your application covers documents originating from
third parties, which were consulted, in line with the provisions of
Article 4(4) of Regulation (EC) No 1049/2001, concerning their disclosure.

 

In reply to our consultation, the third party concerned asked for
information relating to the identity of the applicant (i.e. yourself).
However, disclosure of the applicant's name would entail a transfer of
personal data, falling under the provisions of Regulation (EU) No
2018/1725. According to the provisions of that regulation applicable in
this situation, i.e. Article 5(d) and 7 thereof, obtaining the consent of

We all know that this trick is being used to create another delay and I wish to protest herewith that you willingly participate in this silly game.
May I remind you that I placed my initial FOI inquiry in early December 2018? Over 4 months have passed, and you still use every trick to deny me the information, including making stuff up, like that "broad engagement with stakeholders" which you then admitted to have fabricated, after another month of delays (ARES 16669449, 13.03.2019).

Thank you for your reply. Unless EU Commission fabricates another false claim like that of "broad engagement with key stakeholders", I think I know where this is going. My request is to be portrayed as vexatious or driven by personal obsession or stalking.
I declare pre-emptively that I:
- have never submitted a research paper of any kind to Frontiers
- have never applied for a job of any kind to Frontiers
- am not aware of anyone among my family or friends who did any of the above two
- have never met any Frontiers owners, executives or other employees in person
- have not harassed RJ Smits or Mr and Ms Markram unlike Mr Smits publicly claims, and have never spread any "below the belt" accusations unlike he publicly maintains
- my opinion on Frontiers is based solely on the perceived quality of "scientific" papers I have read there
