Human Rights compromised-European Court of Human Rights
Dear European Union Agency for Fundamental Rights,
Under the right of access to documents in the EU treaties, as developed in Regulation 1049/2001, I am requesting documents which contain the following information:
1.What protection and remedies does the European Union Agency for Fundamental Rights provide me with, as a UK's Settled Resident (EU Citizen) in regards to human rights breaches, if I have strong reasons to believe the European Court of Human Rights has been compromised (biased towards certain citizens, unfair decision making)?
2. Contact details for the complaint about the European Court of Human Rights, about handling of my application of over 700 pages documents and other strong evidence was provided by a Secretary not a Judge as a final decision, decision making process, vague response on a template letter with wording unrelated to my application!, no possibility to appeal the decision, destroying of documents on a response stage and ceasing any communication possibility on that application.
Just to let you know in response to the same by the Council of Europe (see below) I received no information requested:
“We acknowledge receipt of your message of 10 August addressed to the Private Office of the Secretary General and the Deputy Secretary General of the Council of Europe.
Kindly note that the Secretary General of the Council of Europe cannot intervene in individual cases, whether they are submitted to the judicial or administrative bodies of its member states, or to the European Court of Human Rights.
Please kindly also note that there will be no further correspondence from the Private Office of the Secretary General regarding this matter.
Regards, Private Office of the Secretary General and the Deputy Secretary General
Cabinet de la Secrétaire Générale et du Secrétaire Général adjoint
Council of Europe - Conseil de l'Europe
F - 67075 Strasbourg Cedex” Response email 11.08.2021
3. European Court of Human Rights is not listed on this portal, as respondent to any FOI requests.
If that is not the case, please provide details how/to whom such request may be sent.
Please note I would prefer to receive information in electronic form and via Ask the EU portal. This is my right under Regulation 1049/2001. If however you require my personal details anyway, please provide direct e-mail address to deliver the personal details to along with a reference and contact person name .
Yours faithfully,
Katarzyna Paczkowska
Dear European Union Agency for Fundamental Rights,
The response to my request has been delayed. By law, the authority should normally have responded promptly and by September 01, 2021
Please respond to my FOI request urgently.
Yours faithfully,
KatarzynaPaczkowska
Dear Ms Paczkowska,
Please accept our apologies for the late reply.
Regulation (EU) 1049/2001 refers to access to documents. Your request does
not request access to any document but rather information or advise on
your individual case. The Agency, based on its mandate, is not in a
position to deal with such cases. We suggest you however to use the
following tool in order to find the right organisation to help you with
your fundamental rights problem:

Dear FRA - Documents,
I disagree with the decision provided and request Internal Review.
Please provide document which regulation covers EU Citizens, Settled/Pre-settled in UK to be protected by European Union Agency for Fundamental Rights post Brexit, in the current state of affairs.
Also what those protections exactly entail and how to complain about breaches.
Yours sincerely,
Katarzyna Paczkowska

Dear FRA - Documents,
As per my original request I indicated to receive response and document in an electronic form.
I am a Polish EU Citizen settled in the UK. Residing in the UK.
Should you refuse my access to information about my fundamental rights entrapped by free movement idea in UK post brexit, I will complain to the European Ombudsman.
"Please note I would prefer to receive information in electronic form and via Ask the EU portal. This is my right under Regulation 1049/2001. If however you require my personal details anyway, please provide direct e-mail address to deliver the personal details to along with a reference and contact person name ."

Dear European Union Agency for Fundamental Rights,
I am filing the following confirmatory application with regards to my access to documents request 'Human Rights compromised-European Court of Human Rights'.
My apologies for missing this information in my original internal review request.
First. You accepted my FOIA request originally, but now attempt to 'dismiss' my request on the basis of not being EU Citizen, while residing in brexit UK - I wish to highlight I was put in this position and I did not get to vote in the 2016 referendum. I urge you to address this matter as a matter of urgency due to dangerous precedent being created (no EU FOIA )for EU Citizens in UK while EU was well aware of 67% race discrimination in 2019 on the finale of brexit negotiations, intended to leave EU Citizens to deal with 'those' problems alone. And no IMA is not competent and it is only looking to dismiss discrimination complaints interested may seem only in settled matters, as if this would be the only problem we were left with in the country that was ever resistant to free movement from the start and history of slavery and racism.
Second. You responded to me on 03 Sep, sending me on a 'wide goose chase', where UK is no t listed on the portal you provided- e-justice.europa.eu Fundamental Rights Interactive Tool :
"We suggest you however to use the
following tool in order to find the right organisation to help you with
your fundamental rights problem:
[1]https://eur04.safelinks.protection.outlo...
Furthermore UK is also not listed on your web page Where to turn for help:
https://fra.europa.eu/en/about-fundament...
You also state who you are:
"We work together to instil a fundamental rights culture across the EU.
We help bring the Charter to life for everyone in the EU.
The EU founded FRA as an independent body in 2007. Our headquarters are in Vienna."
You also don't seem to have a Liaison Office in UK?
It seems EU FRA has withdrew its protections for EU Citizens stuck in UK post brexit.
On what basis has EU FRA withdrew fundamental rights protection for EU Citizens in UK post brexit?
Please provide document for that.
Please pass this on to the person who reviews confirmatory applications.
A full history of my request and all correspondence is available on the Internet at this address: https://www.asktheeu.org/en/request/huma...
Yours faithfully,
Katarzyna Paczkowska
Dear FRA - Documents,
Thank you for your response.
From the start of this request it is being avoided to be dealt with with my urgent and obviously desperate request; where my human rights are being in jeopardy! You appear to take such reports lightly and avoid dealing with it.
Furthermore despite my request in a digital form, and sending my address for validation purpose only to your personal data team, you decided to make my postal address public without my consent but hiding /blanking out your e-mail address to be used for recourse!
I urge you to correct the digital responses on this portal to exclude my postal address immediatelly.
You did not have my consent to do so and the request was/is via this portal as a means of communication!
See below:
"Whereas it is essential, if man is not to be compelled to have recourse, as a last resort, to rebellion against tyranny and oppression, that human rights should be protected by the rule of law,"Universal Declaration of Human Rights
What transpire to surface is that the FRA has abandoned EU Citizens in UK and did not secure any update post brexit for protections for EU Citizens in UK.
Your response is an evidence throughout and your portal's 'Where to turn for help - Click on your country to see who can help you. Please note some links will take you to the European Commission's E-justice portal."
excludes UK; and the link you sent me above to the European Commission's E-justice portal also excludes UK; and do not consider EU Citizens exposed to hostilities in UK at all.
As mentioned in my original request European Court of Human Rights has been compromised displaying negative bias to e.g. Polish citizen in UK. There is no way of complaining about court staff treatment and no redress process in place and Council of Europe avoid being involved being the headoffice for funding of the Court. Court's President himself wrote a letter to UK Inquiry made public convincing UK about 'good relationship' due to small number of claims being upheld against UK! It appears as lack of impartiality or even corruption due to interference by President and Judges into sustaining UK's funding by 'making it look good'!
Where does this leaves us facing hostility from many angles, daring to speak up of discrimination EU was aware of for decades but happily left EU Citizens locked in i.e. 2019 survey's 67% of race discrimination prevalent in UK !
Please provide document FRA actioning removal of UK from its portal's 'where to turn for help' and all documents in its posession regarding EU Citizens in UK post brexit referendum in Jun 2016.
Please also confirm what recourse is available for EU Citizens in UK by FRA at present and its complaints Policy of maladministration. Please also provide European Court of Human Rights complaint Policy regarding maladministration.
Yours sincerely,
Katarzyna Paczkowska
