Dear Mr Rotherham,

The Citizens’ Enquiries Unit of the European Parliament has been asked to
reply to your request for information with regard to the number of
employed staff found during checks to be ineligible to work in the EU,
over the period of the last five years

We would inform you that, on 18 June 2009, the European Parliament and
Council signed [1]Directive 2009/52/EC providing for minimum standards on
sanctions and measures against employers of illegally staying
third-country nationals. In its Article 14(1), the directive states that
‘Member States shall ensure that effective and adequate inspections are
carried out on their territory to control employment of illegally staying
third-country nationals. Such inspections shall be based primarily on a
risk assessment to be drawn up by the competent authorities in the Member
States.’

In Article 16, the directive stipulates that the European Commission shall
report back to the Council and the Parliament. In this context, the
Commission provided its first [2]communication on the application of
Directive 2009/52/EC on 22 May 2014. Figures are available in the report
with regard to employed staff who are ineligible to work in the EU.
