Impact assessment new genomic techniques

Dear Secretariat General of the European Commission,

Under the right of access to documents in the EU treaties, as developed in Regulation 1049/2001, I am requesting documents which contain the following information:

1. any (draft) impact assessment by the European Commission on legislative initiatives regarding New Genomic Techniques (NGTs) (also called New GMOs)
2. any correspondence between the European Commission (any DG or Commissioner) and (members of) the Regulatory Scrutiny Board on such impact assessment referred to under 1.
3. any (draft) RSB opinions on such impact assessment referred to under 1.

I note that usually the Commission only publishes the IA and RSB opinion when the final legislative proposal is published. However, I note the Judgment of the Court of Justice of the European Union of 4 September 2018 in Case C-57/16 P in which the Court held that documents drawn up in the context of an impact assessment procedure for a legislative proposal constitute legislative documents that should be made directly accessible to the public pursuant to Article 12(2) of Regulation No 1049/2001 before the proposal and that access should not be denied on request.

I look forward to hearing from you.

Yours faithfully,

Nina Holland

Dear Secretariat General of the European Commission,

This is the third time that a reply to my confirmatory application is being postponed. This third time, I'm not even given a new deadline. Seeing the importance of the topic and the timeline, with a proposal from DG SANTE to deregulate New GMOs expected early July, there is a real urgency to inform the public about the preparatory process for this proposal, which we have strongly criticised.

I urge you to prioritise this confirmatory application and give me a clear deadline that will be respected.

Yours faithfully,

Nina Holland
