Increase in environmental noise.

We're waiting for brian dinsdale to read a recent response and update the status.

Dear Environment (ENV),

Under the right of access to documents in the EU treaties, as developed in Regulation 1049/2001, I am requesting documents which contain the following information:

1/ When an environmental impact assessment is used in order to achieve planning for a new road does the assessment have a shelf life ie can our local authority dismiss the assessment and increase noise levels by 25 to 35 dba.

2/ Is the END mandatory or for guidance only.

3/ We live and work alongside this road and we were assured that road noise would not alter by any more than 0.6 db until
the date of 2022 the authority has surface dressed the road with a 14/6 mm aggregate this is ruining our home life and business is there a maximum size aggregate that they must use.

4/ As a business owner i am not allowed to increase environmental noise and we would be prosecuted under UK environmental law is there no such law to control increase in noise by the authorities.

5/ In England we have the noise policy statement for England
this closely mimics the main ethos of the END however our Government has classed it as a vision and our local authority
exploits this and they do not consider it as important please explain to us why our government has not embraced the
END and why are they not fined for infarction.

6/ Having complained to our local authority on many occasions we are unable to alter the situation as it appears
the directors refer everything back to highways and all they do is feed us information that is misleading.
no scoping was carried out.
no environmental assessment was carried out.
no consultation prior to the works being carried out was undertaken.
the first we knew was when they lifted the temporary speed control.

if i am asking the wrong department then please refer me to the correct one.

we have contacted our minister for dept for transport who has not even responded and we are now in what seems a hopeless situation and we do hope that you can offer us some hope.
