Dear Mr Teffer,

 

On 22 June 2022, via the platform [1]asktheeu you asked the European
Ombudsman’s Office to grant you public access to “all documents discussing
the possible participation of the European Ombudsman in an independent EU
ethics body (‘IEB)’, including but not limited to all letters to the
European Commission on this issue.”

 

Your request was registered under the reference number Ares(2022)65337. We
have  dealt with your request in accordance with Regulation
1049/2001[2]^^[1] on public access to documents and the Ombudsman’s
Decision on the handling of requests for public access to
documents[3]^^[2].

 

We have carried out an extensive search in our records. We have neither
received nor sent a letter to the Commission concerning the IEB.

 

We have identified three documents as falling within the scope of the
request:

- a briefing on IEB;

- informal note on EIB;

- an email exchange of 8 October 2020.

 

Please note that the emails represent the personal opinion of individual
staff members and not the official position of the Ombudsman. 

 

We have decided to grant you full access to the first two documents and
partial access to the third document. They are attached to this email. The
minor redactions (name and direct contact details of staff members) in the
third document relate to the need to protect personal data in accordance
with Article 4(1)(b) of Regulation 1049/2001 and Regulation
2018/1725[4]^^[3].

 

Should you wish to challenge this decision, you may request a review under
Article 7(2) of Regulation 1049/2001 (‘confirmatory application’
procedure). You may do so by sending an e-mail to
[5][European Ombudsman request email] within 15 working days of having received this
decision. Our Secretary-General would then handle the review request.
