Information about the application of the Council Regulation (EU) No 833/2014
Dear Mobility and Transport,
Under the right of access to documents in the EU treaties, as developed in Regulation 1049/2001, I am requesting documents which contain the following information:
Any information concerning the development of Council Regulations (EU) No 2022/334 and 2022/328 (amending the Council Regulation (EU) 833/2014) and their application to student pilots and General Aviation pilots holding Russian citizenship and either an EU residence permit or dual citizenship of Russia and the EU, including the minutes of the meetings on the development and application of the above articles, communication with other authorities of the EU on the aforementioned issue, as well as communication with the authorities of EU Member States on this matter.

Please pass this on to the person who reviews confirmatory applications.
I am filing the following confirmatory application with regards to my access to documents request 'Information about the application of the Council Regulation (EU) No 833/2014'.
You have redirected my request to the Directorate‑General for Financial Stability, Financial Services and Capital Markets Union. As justification for that, it was stated that the Directorate-General for Mobility and Transport is not the lead service for restrictive measures.
I completely disagree with this decision. Under the right of access to documents in the EU treaties, as developed in Regulation 1049/2001, I have requested documents from the Directorate-General for Mobility and Transport. In that regard, it does not matter which institution is the lead service for the measures mentioned in my request.
Please be informed that I am aware of the role of the Directorate-General for Mobility and Transport in application of the restrictive measures introduced in Council Regulations (EU) No 2022/334 and 2022/328, which was the reason of my access to documents request. Furthermore, I am aware that the Directorate-General for Mobility and Transport is actively communicating with EU Civil Aviation Authorities (CAAs) on that matter.
I would also like to inform you that, under the German Freedom of Information Act, I received the copy of the E-Mail correspondence between German Ministry of Transport and the Directorate-General for Mobility and Transport, concerning application of the restrictive measures to holders of non-commercial pilot licenses. In particular, I would like to refer to the E-Mail from the German Ministry of Transport sent to [email address] on August 18, 2022, at 10:35 AM CEST.
This is the indisputable evidence that the Directorate-General for Mobility and Transport possess the documents I requested. As resident of the European Union, I have a right of access to these documents.
In view of the above, I object to the redirection of my request to the Directorate‑General for Financial Stability, Financial Services and Capital Markets Union, and request that my request be processed by the Directorate-General for Mobility and Transport.
