Dear Mr. Wetzels,
In your e-mail of Tuesday 12 January 2021, you have requested access to
documents under Regulation (EC) No 1049/2001 of the European Parliament
and of the Council of 30 May 2001 regarding public access to European
Parliament, Council and Commission documents.
Your request concerns :
- All documents, all correspondence (including emails) sent or received,
and all minutes, notes and other reports of and about the meeting that
took place on 4 February 2020 between KLM and the Permanent Representation
of Netherlands to the EU.
- All documents, all correspondence (including emails) sent or received,
and all minutes, notes and other reports of and about the meeting that
took place on 16 January 2020 between RyanAir and the Permanent
Representation of Netherlands to the EU.
- All documents, all correspondence (including emails) sent or received,
and all minutes, notes and other reports of and about the meeting that
took place on 14 January 2020 between Shell and the Permanent
Representation of Netherlands to the EU.
I hereby would like to inform you that Regulation (EC) No 1040/2001 is
only applicable to documents held by an EU institution, that is to say,
documents drawn up or received by it and in its possession.
The Permanent Representation of the Netherlands to the European Union is
not an EU institution, but part of the Dutch government. Regulation (EC)
No 1040/2001 therefore does not apply to documents held by the Permanent
Representation. If you wish to maintain your request, I would advise you
to base your request on the Government Information (Public Access) Act
(Wob). You can address your Wob request to the Ministries that are
responsible for the relevant subject, in this case the Ministry of
Infrastructure and Water Management (for your request relating to the
meetings that took place on 4 February 2020 with KLM and 16 January 2020
with Ryanair) and the Ministry of Foreign Affairs of the Netherlands (for
your request relating to the meeting that took place on 14 January 2020
with Shell).
Please do not hesitate to contact me should you have any further
questions.
Yours sincerely,
Liesbeth A Campo
