Information recording correspondence between the Commission, and/or the EFSA ,and/or industry lobbies in relation to sulfoxaflor and flupyradifurone

Under the right of access to documents in the EU treaties, as developed in Regulation No 1049/2001, POLLINIS France hereby requests the following documents :

The sulfoximine-type pesticides and/or, the active substance sulfoxaflor, and/or the Transform insecticide, and/or the Closer insecticide have been discussed or mentioned; and

The butenolide-type pesticides and/or, the active substance flupyradifurone and/or, the Sivanto insecticide have been discussed or mentioned.

Dear Health and Food Safety,

In your letter ref. Ares(2020)2694518 of 25 May 2020, you ask for a second restriction of the scope of our request for access to documents registered on 17 April 2020 under reference number GESTDEM 2020/2206.

We are surprised by this response as, acquiescing to your previous invitation, we had already reduced the thematic scope of our request roughly by half, by eliminating one of the two substances which constituted the object of our initial request. Your second invitation to also reduce the temporal scope of our request, in line with article 6 paragraph 3 of Regulation (EC) No 1049/2001, seems all the more surprising as article 6 applies only "in the event of an application relating to a very long document or to a very large number of documents". However, as you mentioned in your letter, a similar application for access to documents (ref number GestDem 2018/3664), covering most of the period concerned by our request (1 January 2014 to 10 July 2018), has led to the disclosure of only three documents.

As you inform us that, if we do not reply within five working days to your second invitation to propose a fair solution, you « will unilaterally restrict the scope » of our request, we are reformulating the latter as follows:

All correspondence — including, but not limited to, emails, letters, phone logs, documents, enclosures, minutes of meetings, or any other reports of such meetings — between the Commission, and/or industry representatives (individual companies and industry associations — including lobby consultancies and law firms), and/or the European Food Safety Agency where the sulfoximine-type pesticides and/or, the active substance sulfoxaflor, and/or the Transform insecticide, and/or the Closer insecticide have been discussed or mentioned since July, 10th of 2018.
