Dear Council of the EU,

Under the right of access to documents in the EU treaties, as developed in Regulation 1049/2001, I am requesting documents which contain the following information: all documents that are relevant to the questionnaire of the Council of the EU with regard to it's questionnaire in note 12368/16. From that questionnaire:

"To prepare the follow-up in line with the Justice Ministers' discussion, the Presidency has prepared a questionnaire to map the situation and identify the obstacles faced by law enforcement authorities when gathering or securing encrypted e-evidence for the purposes of criminal proceedings. On the basis of the information be gathered from Member States' replies, the Presidency will prepare the discussion that will take place in the Friends of the Presidency Group on Cyber Issues and consequently in CATS in preparation for the JHA Council in December 2016."

That includes, but is not limited to, documents discussing the need of such a questionnaire, the actual input provided by the member states and the analysis of that input.

On November 21st you have partially answered my request to access documents of the Council of the European Union on the questionnaire on the Encryption of Data. The answer included full access to the input from 11 member states, partial access to the input of 1 member state and the refusal of access to 6 other member states. With that, I am still awaiting access to the input of 7 other member states.

Could you please update me on the status of my request?

Dear SECRETARIAT DGF Access,

Thanks a lot for your update of December 20th. I have two comments:

1) You are writing you haven't received an approval for making public from Austria. In a letter in response to a request of civil rights organization Access Now the Federal Ministry of Justice claims "that Austria has already agreed to the request of the General Secretariat of the Council for public access to the replies to the questionnaire". There should be no procedural hurdles for sending me this particular document.

2) You are writing you haven't received an approval for making public from the Netherlands. While the Dutch government apparently and unfortunately has ignored your request, it did make it public its input.

I hope you will be able to make public the input from the remaining countries (Austria, Greece, Lithuania, Romania and Slovenia) next week as a complete response to my request is long overdue. May I suggest that you consider a lack of response from those countries as an implicit agreement to make their input public?

Dear Mr Zenger,
 
Thank you for your reply and the additional information which we were
unaware of. AT did not inform WHEN they have given their agreement to the
Council so letters may have crossed.
 
We have informed the policy service involved (they are the interface with
the relevant Working Party), taking up your suggestion to consider the
absence of a reply as a tacit agreement and hope to be able to send you a
complete set of replies as soon as possible.
 
However, you will understand that due to the end of year holiday period
and with many delegations already left Brussels, it may not be possible to
make available the input of the missing countries already next week.
 
We apologise once more for the inconvenience that his long procedure has
caused.
