Under the right of access to documents in the EU treaties, as developed in Regulation 1049/2001, I am requesting documents since November 2014 which contain the following information:
- a list of lobby meetings held by this DG with Google or its intermediaries. The list should include: date, individuals attending + organisational affiliation, the issues discussed;
- minutes and other reports of these meetings;
- all correspondence including attachments (i.e. any emails, correspondence or telephone call notes) between this DG (including the Commissioner and the Cabinet) and Google or any intermediaries representing its interests.
- All documents prepared for the purpose of the meeting and/or exchanged during the course of the meeting

We refer to your e-mail dated 7/03/2019 in which you make a request for
access to documents, registered under the above mentioned reference
number.

Your application is currently being handled. However, we will not be in a
position to complete the handling of your application within the time
limit of 15 working days, which expires on 29/03/2019.

An extended time limit is needed as your application concerns a large
number and also documents held by different Services which must be
consulted.
Therefore, we have to extend the time limit with 15 working days in
accordance with Article 7(3) of Regulation (EC) No 1049/2001 regarding
public access to documents. The new time limit expires on 24/04/2019.

Thank you for you reply.

To clarify, you mention that you have used Article 2 of 2014/838/EU, Euratom to define lobby meeting. Can you please confirm that means you have used only the definition of "meeting" and not that it applies only to Commissioners, their cabinet members and Directors-General?

In essence, I would like to know that you have included in the scope of your reply interactions with Google held by officials below the level of Director-General . These would of course be considered as lobbying interactions under the EU Transparency Register.

In your request for access to documents 2019/1359, you requested “a list
of lobby meetings (underlined by us) between DG HOME and Google or its
intermediaries since November 2014, the respective minutes and preparatory
documents of these meetings, and all the correspondence exchange between
DG HOME and Google since November 2014”.

 

As far as the scope of your request is concerned, we referred in our
initial answer to the definition of what a lobby meeting is, to be found
in Article 2 of the Commission decision on the publication of information
on meetings held between Directors-General of the Commission and
organisations or self-employed individuals (2014/838/EU, Euratom) and the
Commission decision on the publication of information on meetings held
between Members of the Commission and organisations or self-employed
individuals (2014/839/EU, Euratom):

-“Meeting” means a bilateral encounter organised at the initiative of an
organisation or self-employed individual or a Director-General to discuss
an issue related to policy-making and implementation in the Union.
Encounters taking place in the context of an administrative procedure
established by the Treaties or Union acts, which falls under the direct
responsibility of the Director-General, as well as encounters of a purely
private or social character or spontaneous encounters are excluded from
this notion;

-“Meeting” means a bilateral encounter organised at the initiative of an
organisation or self-employed individual or a Member of the Commission
and/or a member of his/her Cabinet to discuss an issue related to
policy-making and implementation in the Union. Encounters taking place in
the context of an administrative procedure established by the Treaties or
Union acts, which falls under the direct responsibility of the Member of
the Commission, as well as encounters of a purely private or social
character or spontaneous encounters are excluded from this notion.

 

As a result, we identified the meetings and documents mentioned to our
initial reply.
