Under the right of access to documents in the EU treaties, as developed in Regulation 1049/2001, I am requesting all documentation relating to CESR decisions made about the job move by Jarkko Syyrilä, from the Committee of European Securities Regulators (CESR), to the Investment Management Association (IMA) in 2006.

Specifically, I would like to receive all his job titles at CESR, the areas of responsibility, the dates that these posts were held, the date of his application for permission to move to IMA, the date of the official EU response, whether or not the job move was approved, the reasons given, and any conditions that the EU attached to the approval of this external post at IMA.

Dear European Securities and Markets Authority (ESMA),

    

     Under the right of access to documents in the EU treaties, as

     developed in Regulation 1049/2001, I am requesting all

     Jarkko Syyrilä, from the Committee of European Securities

I would firstly like to apologize for the delayed reply. Please find below
our reply:

 

According to Art 76 para 4 Regulation (EU) Nr 1095/2010 ESMA shall be
considered the legal successor of CESR.

 

We can confirm that Mr. Jarkko Syyrilä has been employed at CESR from 22.
March 2004 till 31. March 2006 as chargé de mission et secrétaire du
groupe d’expert en matière de gestion d’actifs.

 

ESMA has no further documents regarding the further issues to which your
enquiry relates.

 

Please note that - in contrast to ESMA - CESR was not a Union body, but
was an association under French law  and that the EU Staff Regulations and
Conditions for Employment of Other Servants therefore did not apply to its
employees. CESR employees were subject to French labour law which we
understand does not generally require approval from employers when
employees take up new external positions.
