Dear Mr Dohle,

 

The deadline for replying to your application concerning public access to
documents under Regulation (EC) No 1049/2001 registered on 15.01.2020
expires today 05.02.2020.

 

However, your clarification of 29.01.2020 has warranted Parliament to
conduct a supplementary analysis of all legal aspects of your request
application, which is now in the process of being finalised. Therefore,
Parliament is obliged to exceptionally extend the time-limit provided for
in Article 7(1) of Regulation (EC) No 1049/2001 by 15 working days, in
accordance with Article 7(3) of the same Regulation.

 

However, Parliament is likely to be in a position to respond well before
the expiration of the new deadline.

Having analysed your letter, we realise that we had made an unfortunate error with the date of the requested letter. As you rightly indicate, 3 August 2014 is a Sunday.
However, another check from our part clarified that the requested letter is dated 3 August 2004 - FOUR - instead of 2014. Sorry for this confusion created by us.

I kindly request a final check from your side rapidly, considering the fact that the issue is the subject of a legal dispute.

Dear Mr Dohle,

 

In reply to your latest request for access to a document regarding the
petition 706/1999, which you claim is a letter signed by Mr Gemelli, MEP,
with the date 03.08.2004, Parliament would draw your attention to the
decision it sent to you on 07.02.2020 (reference D 302137) signed by the
Secretary general of the European Parliament in reply to your previous
identical request A (2020) 488.

With that decision, Parliament already informed you that Mr Gemelli (whom
you indicate as the person who signed the letter that interests you)
served as an MEP in the European Parliament until July 2004, that is to
say, until the end of the 5^th parliamentary term.

 

By an e-mail of 29.01.2020  Parliament had already sent you the letter
dated 30 October 2003 with reference D 121548 as corresponding to the
description you have provided: it was signed by the Chair of the Committee
on Petitions, Mr Gemelli MEP, addressed to the petitioner Mr Kreutz,
regarding his petition No 706/1999, informing him about the end of the
examination of his petition.

 

Parliament would like to bring your attention to the fact that replying to
repetitive correspondence would be contrary to the principle of good
administration, as enshrined in Article 14(3) of the European Code of Good
Administrative Behavior. Therefore, no further reply concerning the letter
that Parliament has already identified as corresponding to all the
criteria you have provided (except the date) will be given.

 

On this basis, Parliament considers your request handled and the file
closed.
