Under the right of access to documents in the EU treaties, as developed in Regulation 1049/2001, I am requesting documents which contain the following information:

- All communication with the Dutch government, including but not limited to letters and e-mails from and to Commissioner Vălean, regarding the Balanced Approach' procedure for airport Schiphol, between 1 August 2023 and 14 November 2023.

I acknowledge the receipt of DG MOVE's reply to my request for access to Commission documents registered under case number 2023/6840.

Please pass this on to the person who reviews confirmatory applications.

I am filing a confirmatory application with regards to the documents to which access has been denied because of the exception in article 4.2 of Regulation 1049/2001 - the purpose of inspections, investigations and audits.

While I take note that the Commission informs me the review process concerning compatibility with Regulation (EU) No 598/2014 is ongoing, I believe there is an overriding public interest in disclosure.

The Dutch government has informed the Dutch parliament in a letter dated 14 November 2023 that it would suspend its decision regarding Schiphol airport (https://www.rijksoverheid.nl/documenten/...).

The minister for infrastructure and water management refers explicitly to the letter from EU commissioner Vălean, in which she supposedly expressed 'serious concerns' with the intention not to follow the balance approach procedure. The content of this letter is thus referred to as argument for a decision by the Dutch government.

It is in the public interest that citizens and the Dutch parliament may have access to this letter - and possibly other documents involving the issue - so that they can have an informed debate about whether to support the government's decision. The issue involves the extent to which the government can restrict growth for its main airport, which has an effect on the amount of greenhouse gases the Netherlands emits. Considering the importance of tackling climate change, an informed debate about the government's decision is essential and in the public interest.

Moreover, since the issue involves measures that may affect the environment, Regulation (EC) No 1367/2006 also applies.
