List of meetings between EP president and rightsholders

The request was refused by European Parliament.

Dear European Parliament,
president Tajani has been very active on the subject of the copyright directive, both in Italy and internationally, often speaking in name of the Parliament and/or with Parliament resources before key votes.

Under the right of access to documents in the EU treaties, as developed in Regulation 1049/2001, I am requesting documents which contain the following information:

1) a list of meetings (mentioning the meeting date and – if recorded – the specific topic and other attendees)
* with president Tajani and rightsholders (officers, employees or consultants of publishing companies and collecting societies or associations thereof), or other persons and entities known to have a financial interest in the copyright directive,
* happened or scheduled in official premises between June 2018 and February 2019 included,
* which were not listed in the President/Parliament agenda on europarl.europa.eu;

2) any past correspondence, within members of the President's Cabinet and assistants or between them and other people affiliated to EU institutions, on the occurrence of meetings with such rightsholders and on whether to include them in the public agenda, or on general criteria to do so.

Please pass this on to the person who reviews confirmatory applications.

I am filing the following confirmatory application with regards to my access to documents request 'List of meetings between EP president and rightsholders'.

Thank you for your cooperation. I'm happy to see the list published on March 19, however it's evident that it cannot satisfy or supersede my request, because it does not attempt or claim to be exhaustive.
Indeed, I know for a fact that it is incomplete, because it neglects to include at least one meeting with a rightholders representative which I personally "witnessed" at the European Parliament.

I therefore request that you grant access to the documents according to my original request.

Incidentally, I note that I believe it's feasible to satisfy both requests:
1) to produce a list of meetings and related documents, you can inter alia inspect or provide what matches the names of organisations and individuals listed on the transparency register as interested in relevant topics, as well as the EP entrance records in applicable days for all corresponding accredited individuals or visitors who were let in by President Tajani, his assistants or anyone in the Presidency Cabinet;
2) any communication, document or direction related to the preparation and publication of the aforementioned document <http://www.europarl.europa.eu/RegData/pu...> is relevant in shedding a light on "the occurrence of meetings with such rightsholders and on whether to include them in the public agenda" (specifically, how they were previously excluded from the public agenda and how they were identified now).

Dear Mr Leva,

 

In reply to your message of 22 March 2019, Parliament would like to point
out that your application for public access to documents of 1 March 2019
did not identify specific documents. However, Parliament did provide you,
in reply to your application, with a document relevant to your request,
that is to say, a list of meetings, and consequently no formal refusal was
sent to you.

 

Therefore, in view of Article 7(2) of Regulation (EC) No 1049/2001, which
provides that the applicant has the right of making a confirmatory
application “in the event of a total or partial refusal” of the identified
documents, Parliament considers that your application for public access to
documents is still in the initial stage and not in the confirmatory one.
Parliament will take a formal decision on your application within the 12
of April 2019, and this in order not to jeopardize your right to still
submit a confirmatory application should you deem it necessary.

Dear AccesDocs,
thank you, but I don't understand what you mean when you say that my request "did not identify specific documents". My request was flexible so that you could choose whichever way is most convenient for you to produce documents containing the requested information (a comprehensive list of meetings), which might include emails arranging such meetings, event plans, calendar records, requests for communication support or other, memos about the subject and attendees of the meetings, etc.

I think my request is written in "a sufficiently precise manner to enable the institution to identify the document", per article 6 of the Regulation, but if you want to further specify how I can enable you to identify the documents please do so.
