List of political parties on European level and their members of the parliament

Under the right of access to documents in the EU treaties, as developed in Regulation 1049/2001, I am requesting documents which contain the following information:

For the financial years 2015 to 2017, the list of parties on European level which applied for a grant according to regulation 2004/2003, including the list of names of their respective members of the European Parliament, relevant for the distribution of 85% of funding according to Article 10 of regulation 2004/2003.
Additionally, for each party, where applicable, the list of representatives in the European, national or regional parliaments of at least a quarter of member states as required in Article 3 1.(b) of regulation 2004/2003.

Dear Mr Schmid,

 

We refer to your request, under Regulation (EC) No 1049/2001, for the list
of parties at European level which applied for a grant according to
regulation 2004/2003, for 2015, 2016 and 2017, the list of the names of
their Members of the European Parliament (MEPs) relevant for the
distribution of 85% of funding according to Article 10 of Regulation No
2004/2003, as well as, for each party, the list of representatives in the
European, national or regional parliaments of at least a quarter of Member
States as required in Article 3 1.(b) of Regulation 2004/2003.  Parliament
needs you to supplement your request in order to process it.

 

The lists of representatives that the political parties file with the
Parliament with a view to establishing that they meet the conditions of
Article 3.1(b) of Regulation No 2004/2003 is made of names of MEPs as well
as names of members of national and regional parliaments. The names and
political affiliations of the MEPs become public when they join the
European Parliament.  However, the names and the political affiliation at
European level of the members of national and regional parliaments is not
systematically available to the public. Therefore Parliament is obliged to
treat that information as personal data protected under Regulation No
45/2001

The Court of Justice of the European Union has ruled that where a request
of access to documents under Regulation (EC) No 1049/2001 seeks to obtain
access to personal data, the data protection Regulation (EC) No 45/2001
has to be applied in its entirety. Among others, Article 8(b) of this
latter regulation specifies, inter alia, that personal data shall only be
transferred to recipients other than Community institutions and bodies "if
the recipient establishes the necessity of having the data transferred
[…]".

 

On this basis, Parliament kindly invites you to demonstrate, by 
19.12.2016 at the latest, the "necessity" of transferring the personal
data in question to you. Until reception of this information, your
application lodged under Regulation (EC) No 1049/2001 is to be considered
as incomplete, and the statutory deadline cannot run. In the absence of
any further information from your side within the deadline indicated,
Parliament will adopt a decision with regard to your application, pursuant
to Regulation (EC) No 1049/2001, on the basis of the request as it stands.

 

While your request for access to documents is being treated, you are
informed that a table of the political parties at European level that have

thanks for your response. I have a couple of additional request concerning this matter

1. You state "The names and the political affiliations of the MEPs are available on the
[...] Parliament webpage". However, the mentioned webpage only states the national party affiliations, not the affiliations to political parties on European level.
Please provide the list of affiliations of MEPs to political parties at European level.

2. You state "the names and the political affiliation at European level of the members of national and regional parliaments is [...] as personal data protected under Regulation No 45/2001". Also I am not aware of any political systems in which the affiliation of a parliament member is seen as "personal data", I accept your response.
However, I ask you to provide an anonymised list, that is the number of members of national and regional parliaments per political party on European level.

3. You state "a table of the political parties at European level that have applied for and received grants is available on the [..] Parliament webpage". However, the mentioned webpage only lists the political parties at European level which have received grants. It does however not list the parties which applied for and did not receive a grant. Given the information on the mentioned webpage, for the financial years 2011, 2013, 2015 and 2016, respectively, one proposal each from a party which applied for grant for this financial year was refused.
Please provide the list with the names of the parties for which application was refused in these four cases.

Please find attached tables gathering the anonymised information you asked
regarding the national (MP) and regional (MRP) representatives that
supported political parties at European level for the purpose of Article
3(1) b of Regulation, as well as the MEPs, for each political party at
European level.

 

As regards the 2016 financial exercise, the Secretary General’s proposal
to the Members of the Bureau dated 4 December 2015 lists the parties that
applied for funding and discusses which ones were not retained (if any).
The annexes to that document contain the list relevant for the
distribution of the 85% of the available appropriations between the
political parties at European level according to Article 10 of Regulation
