Lithuanian ESIF measure “Modernisation of public and private cultural infrastructure (07.1.1-CPVA-K-306)”

Dear Sir or Madam,

Under the right of access to documents in the EU treaties, as developed in Regulation 1049/2001, I am requesting the following information.

The Republic of Lithuania, with the support of European Structural and Investment Funds, under the 2014-2020 Operational Programme priority axis 7 (promoting sustainable and quality employment and supporting labour mobility) is implementing a measure “Modernisation of public and private cultural infrastructure (07.1.1-CPVA-K-306)”.

One of the projects, to be financed under this measure is the intended demolition of a historic cinema building („Garsas“) and buidling the Stasio Eidrigevičiaus art centre in Panevezys. This has generated significant controversy and opposition by the civil society both nationally (a petition countering the projet signed by more than 3000 citizens) and on the European level (i.e. public calls by European cinemas and architects to preserve the historic building).

Furthermore, irregularities in project planning and implementation have also been identified. For example the illegality of the building permit, issued not in accordance to applicable regulation at the time of application for project financing and the related ex-post corrections, as stated in the regional administrative court of the Republic of Lithuania case decision Nr. eI3-4161-621/2020.

All this has caused significant delays in project implementation, with the final decisions by the managing authority, as regards the project financing, being made in 2021, already after the expiration of the 2014-2020 Multi-annual financial framework.

As a consequece, we would kindly request to provide all and any documents on the issues related to this ESIF measure and the mentioned project, as described above.

More specifically, we would also kindly request:
- Any documentation that the Commission may have, as regards the planning and implementation of the said ESIF measure, including possible discussions in the programme committees, review missions or other related actions as well as any revisions of the Operational Programme in connection with this measure;
- Any documentation that the Commission may have as regards the eligibility of financing for projects int his context, who‘s activities receive their final approval after the expiration of the 2014-2020 MFF;
- Any documentation as regards the principles of evaluation of eligibility of financing of activities, in cases where invalid documents are being submitted for the evaluation, when the validity of those documents is being correct ex-post as well as the principles and information applicable to this particular case;
- Any documentation that the Commission may have as regards the requirements of the preservation of cultural heritage and the involvement of non-governmental sector in planning initiatives co-financed by the ESIF, applicable for projects supported by Union co-financing and the obligations of the Member States, for example, but not limited to, obligations foreseen in the Partnership agreement with the Republic of Lithuania;
