Lobbying on Chlorpyrifos and Chlorpyrifos-methyl
Dear Health and Food Safety,
Additionally to my request registered
on 10 march 2020 under reference number GestDem 2020/1408 and under the right of access to documents in the EU treaties, as developed in Regulation 1049/2001, I am requesting documents which contain the following information:
- Correspondence, including emails, between officials and NGO´s or other organisations working on the assessments and/or nonrenewals of Chlorpyrifos and Chlorpyrifos-methyl from the years 2013 to 2019.
- This includes (but is not limited to) correspondence between NGO´s or other organisations and any members or representatives of SCoPAFF during this period that mentions or pertains to Chlorpyrifos and Chlorpyrifos-methyl between 2013 to 2019
- Please specifically include all correspondence between the following representatives of PAN Germany, PAN Europe, HEAL, ecolologistas en accion, Générations Futures and EU officials or representatives involved in the assessment and/or (non)renewal of Chlorpyrifos and Chlorpyrifos-methyl, including any members or representatives of SCoPAFF, which mentions or pertains to Chlorpyrifos and Chlorpyrifos-methyl, between the years 2013 and 2019
- Please also include all agendas or minutes of meetings with these parties during the years 2013 and 2019 that mentions or pertains to the assessments or renewals of Chlorpyrifos and Chlorpyrifos-methyl:

Dear Mr Langkutsch,
We refer to your requests dated 9 March 2020 (GestDem 2020/1408), your
request sent on 16 March 2020 updating the scope of your previous request
(GestDem 2020/1541) and to your request dated 12 March 2020 (GestDem
2020/1564) addressed to DG AGRI and re-attributed to DG SANTE. These
requests for access to documents, registered respectively on 10 March
2020, 17 March 2020 and 18 March 2020 under the hereby mentioned reference
numbers will be treated jointly as a single application.
Your application is currently being handled. However, we will not be in a
position to complete the handling of your application within the time
limit of 15 working days, which expires on 7 April 2020.
An extended time limit is needed as part of the documents requested
originate from third parties which have been consulted;
Therefore, we have to extend the time limit with 15 working days after
your clarification was received in accordance with Article 7(3) of
Regulation (EC) No 1049/2001 regarding public access to documents. The new
time limit expires on 4 May 2020.

Dear Mr Langkutsch,
We have received an application for access to documents made under
Regulation (EC) 1049/2001 ("the Regulation"). Please find here a link to
the Regulation.
The applicant requests access to documents which were sent to the
Commission by you, namely your access to documents requests registered
under the GestDem numbers No 2020/1408, 2020/1541, 2020/1564.
The general principle of Regulation 1049/2001 is to grant the widest
possible access to any document held by an EU-institution which is
requested under this Regulation. The institution only refuses disclosure
of (a part of) the requested document(s), if disclosure would undermine
the protection of a specific interest as laid down in Article 4 of this
Regulation.
As regards third-party documents, Article 4, paragraph 4 of Regulation
1049/2001 provides that the institution shall consult the third party with
a view to assessing whether an exception in paragraph 1 or 2 is
applicable, unless it is clear that the document shall or shall not be
disclosed.
With a view to handling this application, we invite you to indicate
whether you agree with disclosure of the documents originating from you
or, on the contrary, object to disclosure. In case you wish to object to
disclosure, we kindly ask you to indicate how in your view, disclosure
would affect one of the interests
protected under Article 4, paragraphs 1 or 2 of Regulation 1049/2001.
Please note in this respect that the personal data of staff in your
organization, signatures, and contact details of individuals will be
redacted by default, with reference to Article 4(1)(b) (protection of
privacy and the integrity of the individual) of Regulation (EC) No
1049/2001
In case you consider that the documents could be partially released, we
would kindly ask you to indicate the (parts of the) documents that should
be withheld and to give reasons for withholding them. The documents are
attached for your convenience.
In order to enable us to reply to the request for access within the
prescribed time limit, we would be grateful if you could inform us as soon
as possible and in any case within five working days upon receipt of this
letter, your position as regards the disclosure of the documents
concerned.
In case we do not receive a reply within the prescribed time-limit, we
will take a position on disclosure of the documents requested taking
account of the legitimate interests of your company on the basis of the
information in our possession.
