Lobbying re. Collaborative Economy - DG CNECT
Dear Communications Networks, Content and Technology,
Under the right of access to documents in the EU treaties, as developed in Regulation 1049/2001, I am requesting documents which contain the following information:
(i) a list of meetings between DG CNECT officials and/or representatives (including the Commissioner and her Cabinet) and
- representatives of collaborative economy platform companies (such as, but not limited to, Amazon (including Amazon Mechanical Turk/ ‘MTurk’), Deliveroo, TaskRabbit, Upwork, HomeAway, ClickWorker, Wimdu, Interhome, etc);
- consultancies or law firms acting for any of these companies (such as, but not limited to, FIPRA International, FTI Consulting, Covington & Burling, Technology Policy Advocates, acumen public affairs, Gide Loyrette Nouel, Flint Europe, EUROS / AGENCY, Delany & Covely, etc);
- representatives of the Consumer Choice Center, Sharing Economy Ireland, Asociación Española de la Economía Digital (adigital), and any other collaborative economy platform interest groups; and,
- representatives of cross-sectoral industry federations (such as, but not limited to, BusinessEurope and AmCham EU),
at which the Collaborative Economy Communication, or follow-up to it, was discussed (since January 2015);
(ii) minutes and other reports of these meetings;
(iii) all correspondence (including emails) between DG CNECT officials and/or representatives (including the Commissioner and Cabinet) and representatives of the entities listed in part (i), concerning the Collaborative Economy Communication, or follow-up to it, since January 2015.
I am aware of previous access to documents requests published on the website asktheeu.org which cover some of the documents that I am interested in (namely those registered under GestDem 2017/5435 and GestDem 2017/5430). Therefore, please consider my request to exclude the following organisations, which are covered under these earlier requests: Uber, AirBnB, European Internet Forum, the Computer and Communications Industry Association (CCIA), European Holiday Home Association (EHHA), Sharing Economy, European Collaborative Economy Forum (EUCoLab) and European Digital Media Association (EdIMA).
I would be grateful if you could take the Code of Good Administrative Behaviour into account when considering (i) of this request.
I would also kindly ask that you release documents relating to this request as soon as they are ready (ie in instalments, if necessary). I am aware that part (iii) may take longer for you to prepare, so I would appreciate if you could ensure that parts (i) and (ii) are not delayed whilst part (iii) is being prepared.

Thank you for your email of 7th February 2019 (copied below), asking for clarifications re. my request GestDem No. 2019/0469. I confirm that I am interested in meetings and documents related specifically to the 2016 Communication on collaborative economy. With regard to the type of 'follow-up' I am interested in, I confirm that, in relation to this part of my request, the clarification I provided to DG GROW re. my similar request (GestDem 2018/6883) to them (namely, that for the period after the communication's adoption, I am interested in meetings and documents in which the 2016 Communication was subject of discussion), should also be considered to apply in this case.
With regard to your reference to Article 2, third paragraph of the Implementing Rules to Regulation 1049/2001, that states that the 15 working days time limit for handling my application will start running when you receive the requested clarifications, I would like to note the following:
- my original request was tabled on 13 December 2018;
- I did not receive acknowledgement of receipt of this request until 25 January 2019, when my request was registered under reference number GestDem 2019/0469;
- I was given no explanation for the 1.5 month delay in registering my request;
- in the the email registering my request, you informed me that my application would be handled within 15 working days, with that time limit to expire on 15/02/2019;
- nearly two weeks (9 working days) later, you asked me for clarification of my request, stating that the 15 working day time limit would newly apply once you have received my clarification.
Given the extraordinary delay in registering my request, and the fact that your request for clarification did not come until nearly 2/3 of the 15 working day time limit that I was initially informed of had passed, I would kindly ask you to respond to this request as swiftly as is possible, and without further delays.
I hope my clarification suffices, and if you have any further questions, please let me know promptly.

Your application is currently being handled. However, we will not be in a
position to complete the handling of your application within the time
limit of 15 working days, which expires on 28/02/2019.
An extended time limit is needed as your application concerns documents
held by different Services which must be consulted and most of the
documents falling within the scope of your application originate from
third parties which are being consulted.
Therefore, we have to extend the time limit with 15 working days in
accordance with Article 7(3) of Regulation (EC) No 1049/2001 regarding
public access to documents. The new time limit expires on 21/03/2019.
