Under the right of access to documents in the EU treaties, as developed in Regulation 1049/2001, I am requesting documents which contain the following information:
Can you publish any documents on how much time he has spent at the agency since his appointment? As it has been claimed he was based in the US.
What expenses did he claim for travel? Do any of the expenses date before his appointment on 01/01/2020?
Is he going to get any compensation for leaveing his post?
Has he signed a NDA?
Will his pension be under review as what he says may dmange the EU?

Dear Mr Hai,
I refer to the request for access to documents which you made on 9 April
2020, registered on 17/04/2020 under GestDem 2020/2220. This request
concerns the former President of the European Research Council, Mr Mauro
Ferrari.
You will receive a separate reply to the first two points of the request
from other Commission services.
The last three points of your request are worded as follows:
“Is he going to get any compensation for leaving his post?
Has he signed a NDA?”
Will his pension be under review as what he says may damage the EU?”
Given the wording of those questions, it has been decided to treat this
part of your request as a request for information and to give you a reply
on this basis under the Code of Good Administrative Behaviour.
Mr Ferrari has been engaged with the administrative status of Special
Adviser to the Commission. The rules on Special Advisers are laid down in
Articles 5, 123 and 124 of the Conditions of Employment of Other Servants
of the European Union (a copy of the Staff Regulations of Officials of the
European Union and the Conditions of Employment of Other Servants is
attached for your convenience). These Articles do not provide for any
payment in case of termination of a contract before its normal end date.
Accordingly, Mr Ferrari did not receive any compensation for leaving his
post.
Special Advisers do not acquire any pension rights either. Mr Ferrari will
therefore not receive a pension from the European Commission.
The signature of a non-disclosure agreement was not necessary since
Article 17 of the Staff Regulations applies by analogy to Special
Advisers. According to this provision, an official must, even after
leaving the service, refrain from any unauthorised disclosure of
information received in the line of duty, unless that information has
already been made public or is accessible to the public. Mr Ferrari has,
as all Special Advisers to the Commission, been explicitly informed about
this obligation.

Your application is currently being handled. However, we will not be in a
position to complete its assessing within the time limit of 15 working
days, which expires on 11/05/2020.
An extended time limit is needed as the application concerns documents
held by different Services which must be consulted.
Therefore, we have to extend the time limit with 15 working days in
accordance with Article 7(3) of Regulation (EC) No 1049/2001 regarding
public access to documents. The new time limit expires on 04/06/2020.
