Dear European Research Council Executive Agency,

Under the right of access to documents in the EU treaties, as developed in Regulation 1049/2001, I am requesting documents which contain the following information:

Can you publish any documents on how much time he has spent at the agency since his appointment? As it has been claimed he was based in the US.

What expenses did he claim for travel? Do any of the expenses date before his appointment on 01/01/2020?

Is he going to get any compensation for leaveing his post?

Has he signed a NDA?

Will his pension be under review as what he says may dmange the EU?

Yours faithfully,

Abdul Hai

Dear Mr. HAI:

Thank you for your e-mail of 09 April 2020. We hereby acknowledge receipt
of your application for access to documents, which was registered on 17
April 2020 under reference number GESTDEM 2020/2220.

In accordance with Regulation (EC) No 1049/2001 regarding public access to
European Parliament, Council and Commission documents, your application
will be handled within 15 working days. The time limit will expire on 11
May 2020. In case this time limit needs to be extended, you will be
informed in due course.

You have lodged your application via a private third-party website, which
has no link with any institution of the European Union. Therefore, the
European Commission cannot be held accountable for any technical issues or
problems linked to the use of this system.

Please note that the private third party running the AsktheEU.org website
is responsible and accountable for the processing of your personal data
via that website, and not the Commission. For further information on your
rights, please refer to the third party’s privacy policy.

We understand that the third party running the AsktheEU.org website
usually publishes the content of applicants’ correspondence with the
Commission on that website. This includes the personal data that you may
have communicated to the Commission (e.g. your private postal address).

Similarly, the third party publishes on that website any reply that the
Commission will send to the email address of the applicants generated by
the AsktheEU.org website.

If you do not wish that your correspondence with the Commission is
published on a private third-party website such as AsktheEU.org, you can
provide us with an alternative, private e-mail address for further
correspondence. In that case, the Commission will send all future
electronic correspondence addressed to you only to that private address,
and it will use only that private address to reply to your request. You
should still remain responsible to inform the private third-party website
about this change of how you wish to communicate with, and receive a reply
from, the Commission.

Yours faithfully,

RTD Access to Documents Team

Dear Mr Hai,

With regard to your access to documents request, registered under
reference GestDem 2020/2220, we would like to inform you that:
Based on our preliminary analysis, your request has been split as follows:

The first two questions in your message are handled by DG RTD as a request
for access to documents in the framework of Regulation 1049/2001.

''     - Can you publish any document on how much time he has spent at the
agency since his appointment?
       - What expenses did he claim for travel? Any before his appointment
on 01.01.2020?''

The last 3 questions in your message are going to be handled directly from
the Directorate General for Human Resources as a request for information
on the basis of the Code of Good Administrative Behaviour.

"   - Is he going to get any compensation for leaving his post?
      - Has he signed a NDA?
      - Will his pension be under review as what he says may damage the
EU?"

Kind regards,

Dear Mr Hai,

I refer to the request for access to documents which you made on 9 April
2020, registered on 17/04/2020 under GestDem 2020/2220. This request
concerns the former President of the European Research Council, Mr Mauro
Ferrari.

You will receive a separate reply to the first two points of the request
from other Commission services.

The last three points of your request are worded as follows:

“Is he going to get any compensation for leaving his post?

Has he signed a NDA?”

Will his pension be under review as what he says may damage the EU?”

Given the wording of those questions, it has been decided to treat this
part of your request as a request for information and to give you a reply
on this basis under the Code of Good Administrative Behaviour.

Mr Ferrari has been engaged with the administrative status of Special
Adviser to the Commission. The rules on Special Advisers are laid down in
Articles 5, 123 and 124 of the Conditions of Employment of Other Servants
of the European Union (a copy of the Staff Regulations of Officials of the
European Union and the Conditions of Employment of Other Servants is
attached for your convenience). These Articles do not provide for any
payment in case of termination of a contract before its normal end date.
Accordingly, Mr Ferrari did not receive any compensation for leaving his
post.

Special Advisers do not acquire any pension rights either. Mr Ferrari will
therefore not receive a pension from the European Commission.

The signature of a non-disclosure agreement was not necessary since
Article 17 of the Staff Regulations applies by analogy to Special
Advisers. According to this provision, an official must, even after
leaving the service, refrain from any unauthorised disclosure of
information received in the line of duty, unless that information has
already been made public or is accessible to the public. Mr Ferrari has,
as all Special Advisers to the Commission, been explicitly informed about
this obligation.

Yours sincerely,

Susan Panter

Head of Unit HR.C.1

European Commission

Dear Mr HAI,

We refer to your e-mail dated 09/04/2020 in which you make a request for
access to documents, registered on 17/04/2020 under the reference number
2220.

Your application is currently being handled. However, we will not be in a
position to complete its assessing within the time limit of 15 working
days, which expires on 11/05/2020.

An extended time limit is needed as the application concerns documents
held by different Services which must be consulted.

Therefore, we have to extend the time limit with 15 working days in
accordance with Article 7(3) of Regulation (EC) No 1049/2001 regarding
public access to documents. The new time limit expires on 04/06/2020.

We apologise for this delay and for any inconvenience this may cause.

Yours faithfully,

European Commission
