I am filing the following confirmatory application with regards to my access to documents request 'Meeting with lobbying firm f30'.

My request is now nearly four weeks overdue. It covers only one specific lobby meeting and I was not told of any extension of the deadline, so I hope a review can expedite access to the documents.

As part of the review I would like to point out that my request is in the public interest, as I am a journalist and am investigating the subject in question.

Also, I would like to ask to limit possible exceptions claimed under Article 4 1. (b) of Regulation 1049/2001, as I have reason to believe the lobbyist mentioned in the document is a former senior official who is a public figure and should not be anonymized to allow scrutiny of his current role.

I am filing the following confirmatory application with regards to my access to documents request 'Meeting with lobbying firm f30'.

Access to parts of the requested documents has been denied pursuant to Article 4(1)(b) of Regulation (EC) No 1049/2001, as the Commission argues its disclosure would undermine the protection of privacy and the integrity of the individual. "The public disclosure of this personal data would constitute processing (transfer) of personal data within the meaning of Article 9(1)(b) of Regulation (EU) 2018/1725."

I want to challenge that decision on the grounds of a specific public interest in regards to one person mentioned in particular, the representative of lobbying firm f30. I have reason to believe this representative to be Gerhard Schindler, the former head of the German intelligence service Bundesnachrichtendienst.

I would like to remind the Commission of Article 28 of the preamble of Regulation (EU) 2018/1725, which sets out that transmission of personal data can be justified in the public interest. "The specific purpose in the public interest could relate to the transparency of Union institutions and bodies", the article notes. My confirmatory application set out why I believe such a specific purpose exists. I further believe it should be grounds to release the documents without redacting the name of the f30 representative.

First, I would like to establish that Mr. Schindler is a public figure. This is demonstrated by him having an entry on Wikipedia [1] as well as frequently and recently [2] [3] speaking out on current topics in interviews with the media. He has also described his work with f30 in media interviews [4], albeit without mentioning his representations visavis European Union institutions. I would like to argue that Mr. Schindler's work as a lobbyist shall not be seen as 'private', but as extension of his public role, which must allow for public scrutiny. I would also like to point out that my employer, netzpolitik.org, has frequently reported about Mr. Schindler [5] and I should not be prevented from doing the same.

My intention in seeking documents pertaining to the work of f30 is to highlight attempts to use a reputation gained as public official for later employment as lobbyist. Insight into lobbying activity by former officials such as Mr. Schindler is crucial in understanding political decisions taken in the aftermath. It clearly relates to to the transparency of Union institutions and bodies.

I have every intention to use information gained on these grounds for my reporting work and would like to argue that this constitutes the 'specific purpose' necessary for releasing the data. I therefore ask to review the decision and release the documents without redacting the name of the f30 lobbyist.

Dear Mr Fanta,

 

I refer to your email of 3 January 2020, registered on the same day, by
which you submit a confirmatory application in accordance with Article
8(1) of Regulation (EC) No 1049/2001 regarding public access to European
Parliament, Council and Commission documents ("Regulation (EC) No
1049/2001"), registered under reference number GESTDEM 2019/5070.

 

Your confirmatory application is currently being handled. Unfortunately,
we have not yet been able to gather all the elements needed to carry out a
full analysis of your request and to take a final decision. Therefore, we
were not in a position to reply to your confirmatory request within the
prescribed time limit which expired on 24 January 2020.

 

Consequently, we had to extend this period by another 15 working days in
accordance with Article 8(2) of Regulation (EC) No 1049/2001. The new
deadline expires on 14 February 2020.

 

However, I can assure you that we are doing our utmost to provide you with
a final reply within the next 15 working days.

 

I regret this additional delay and sincerely apologise for any
inconvenience this may cause.
