As catalogued in the TRIS database, at least two member states (Italy and Sweden) issued comments on notification number 2017/127/D during the standstill period.

Under the right of access to documents in the EU treaties, as developed in Regulation 1049/2001, I am requesting all documents which contain the reactions of the Commission and the Member States to that notification ('Act improving law enforcement on social networks').

I would like to obtain:
1. the comments issued by Italy and Sweden
2. the draft law assessment on 2017/127/D put together by JUST and CNECT, and shared internally between JUST and CNECT via email on 23 May 2017 [potential reference number: Ares(2017)5237754]
3. any other analysis, commentary or opinions on the notification 2017/127/D from the Legal Service, DG CNECT, DG GROW, DG JUST, or other DGs, including draft reports, memos, or other documents

In case that documents should be classified or cannot be released because of exceptions of special treatment, I am asking for the name, source (e.g. the institution, DG and unit) and any reference number of these documents. If information under the scope of regulation 1049/2001 is not held by DG GROW but by the Commission, the Commissioner or another DG or Commission unit, I would like this information to be included in this request.

I am filing the following confirmatory application with regards to my access to documents request 'Member state comments on NetzDG': I accept the arguments made by Mr. Romero Requena regarding the refusal of the requested document in section 2 of my freedom of information request (the draft law assessment prepared by the legal service on TRIS notification 2017/127/D). However, the Legal Service apparently failed to consider the other point of my request (Sec. 3), which pertained to other analysis, commentary or opinions on the notification 2017/127/D from the Legal Service. For this reason, I would like to forward my response for further review.

Mr. Romero Requena noted that the specific document I requested did not represent the final opinion of the legal service; I would like to receive, as mentioned in my original request, all other documents that contain analysis of the legal ramifications of the 2017 NetzDG notification (including its compatibility with the E-Commerce Directive and the ECHR). Part of this request includes documents that do contain the final opinion of the Legal Service on this matter, which I believe is squarely within the public interest as the evaluation of the NetzDG is underway in Germany.

same day under reference Gestdem 2020/3307, by which you submit a
confirmatory application in accordance with Article 7(2) of Regulation
1049/2001 regarding public access to European Parliament, Council and
Commission documents[6]^[1] (hereafter Regulation 1049/2001).

 

I also refer to our holding reply of 15 July 2020, by which the time limit
for replying to your confirmatory request was extended by 15 working days,
pursuant to Article 8(2) of Regulation 1049/2001. This extended time limit
expires on 7 August 2020.

 

Unfortunately, we are not yet in a position to provide you with our final
position within this deadline.

 

However, I can assure you that we are doing our utmost to provide you with
a final reply as soon as possible. I regret this additional delay and
sincerely apologize for any inconvenience this may cause.
