I am filing the following confirmatory application with regards to my access to documents request registered on 28/09/2018 under reference number GestDem 2018/5081.

DG CLIMA argued that all documents must be kept confidential to protect the decision-making process of the Commission, “as it would reveal preliminary views and policy options which are currently under consideration”.

I would like to refer to a previous access to documents request, registered on 08 January 2018 under Ref GestDem No 0148/2018. In response to that request, the Commission released several papers which provided preliminary views and policy options that were prepared in relation to the Commission Notice of 26.9.2017 on the application of EU food and consumer protection law to issues of Dual Quality of products – The specific case of food.

The fact that the Commission was then able to release those documents, revealing preliminary views and policy options, showed that there was no risk to the decision-making process.

I also would like to point to the greater public interest, which could override the exception cited by the Commission.

The non-paper in question has been published a week before the European Parliament voted on the Commission's proposal. The rapporteur in charge of steering the file through parliament has said the non-paper contained “misleading figures”. To set the record straight for the public, it would be imperative for the public to determine the preparatory work leading up to the non-paper. It is precisely because questions have been raised about the methodology of the non-paper that it is in the public interest – as well as in the Commission's interest – to be transparent about the documents I requested.
