Official position of the Finnish government on fisheries transparency
Dear Permanent Representation of Finland to the EU,
Under Finland’s Publicity of Public Authorities Act 621/1999 (Laki viranomaisten toiminnan julkisuudesta), I kindly request access to any document in your possession on the position of the Finnish government on the amendments proposed by the European Parliament on 10 March 2021 on the EU fisheries control Regulation.
I am specifically interested in the amendments to articles 93 and 113 to of Regulation (EC) No 1224/2009 - the EU Fisheries Control Regulation, which are currently being discussed in trilogue negotiations between the European Parliament, Council and Commission.
I am requesting documents, including emails and meeting minutes, that include information on the position of the Finnish government on the above.
Given that the trilogue discussions are ongoing, I would appreciate a speedy response to my request.

Dear Martina Tombini,
Thank you for your interest in the Finnish positions concerning amendments
proposed by the European Parliament. You have requested on the 11th of
October 2021 access to any document in the possession of the Permanent
Representation of Finland to the EU on the position of the Finnish
government on the amendments proposed by the European Parliament on 10
March 2021 on the EU fisheries control Regulation. You are specifically
interested in the amendments to articles 93 and 113 of Regulation (EC) No
1224/2009.
Permanent Representation of Finland to the EU has transferred the request
to the Ministry of Agriculture and Forestry on the 5th of November 2021.
Your request for information is registered in the case management system
of the Government under number VN/28440/2021.
The answer to your request is the following:
The Finnish positions on articles 93 and 113 are shortly mentioned only
in a Council document where Finnish comments on the amendments proposed by
the European Parliament were given. Any official meeting minutes or
e-mails concerning position making on the amendments on articles 93 or 113
have not been drafted or submitted. These articles are not among the main
concerns of Finland in the revision package and they have not been a major
topic of discussions.
The positions taken are based on public position making by the Finnish
Parliament and it can be found in the website of the Parliament. The
relevant formulation can be found in the opinion of the Agriculture and
Forestry Committee, which was confirmed by the Grand Committee:

In the context of your request attention should be paid to the convergent
positions of the Government and the Parliament according to which
fisheries control must be adapted to the specific characteristics of each
area and form of fishing, and any mandatory requirements and methods
oversized with the objectives of the common fisheries policy should not be
introduced. In this light, Finland has expressed the following positions:
Article 93, paragraph 2: "Stick to GA", where GA means Council General
Approach. Other paragraphs of the Article 93 were not commented.
Article 113: "Cannot support EP", where EP means European Parliament.
I hope this reply answers to your question. According to section 14 of the
Act on the Openness of Government Activities 621/1999, you may, if you
wish, obtain a decision from the authority on this matter, which in the
event of a negative decision includes a right of appeal to an
administrative court. The decision would be given in Finnish or Swedish.
