Operations in Hungary

Dear European Border and Coast Guard Agency,

Under the right of access to documents in the EU treaties, as developed in Regulation 1049/2001, I am requesting documents which contain the following information:

1. The mandate of Frontex operational activities at the Hungarian-Serbian border (JO FOA 2016 Land/WB) and any changes thereto.
2. If available, the training manual/guidance/standards of procedure given to Frontex personnel deployed at the Hungarian-Serbian border, specifically as to the required steps taken should a third country national expresses their intention to seek asylum.
3. All official correspondence and/or internal notes or position papers in regard to
a. The effect on the mandate and on Frontex activities of the amendment to Section 71/A of Act LXXX of 2007 on Asylum and newly added Section 5 (1a) of Act LXXXIX of 2007 on State Borders, entered into force on 5 July 2016, that legalise the push-back of third country nationals without the right to stay in Hungary within 8 kilometres of the Serbian-Hungarian border to the external side of the border fence without the right to lodge an asylum application;
b. The effect on the mandate and on Frontex activities of the insertion of Section 80/J of Act LXXX of 2007 on Asylum, entered into force on 28 March 2017, prescribing that asylum applications can only be lodged inside the transit zones and that any third country national staying illegally anywhere on the territory of Hungary is pushed back to the external side of the border fence at the closest gate to their apprehension.
4. Reports, or if they cannot be made public, their exact number, on push-backs (see description in 3a. and b.) witnessed by Frontex personnel deployed at the Hungarian-Serbian border.
5. Reports, or if they cannot be made public, their exact number, on violence witnessed by Frontex personnel deployed at the Hungarian-Serbian border.
6. Documents pertaining to the exact mechanism for victims of abuses to file a complaint to Frontex officers deployed at the Hungarian-Serbian border on sight.
7. The number of reports of incidents filed by the Serbian Police to the Hungarian Police that was received by Frontex between 5 July 2016 and 31 August 2017 and any official documents and/or report on steps taken produced by Frontex as a consequence of these incident reports.
8. The current number of Frontex personnel deployed at the Hungarian-Serbian border.

-          The personal data is collected for the exclusive purpose of
assessing the nationality of the applicant

-          The recipients of the personal data are the 3 Frontex Staff
members (Senior Legal Officer, Junior Lawyer and Legal Assistant) handling
requests for public access for documents

-          The personal data collected (that is, the document sent to the
PAD mailbox) will be deleted as soon as the access for the request
document(s) is granted or refused.  In Frontex, this procedure takes no
longer than 15 or 30 working days depending on the number/size of the
requested documents. During the processing of your data, you have a right
to access your data and rectify them if needed. You have a right to have
recourse to the European Data Protection Supervisor.
