Dear Mr Carrière,
Please allow me to refer to the correspondence concerning your request for
access to documents, registered with reference GestDem 201/3603.
In the reply of 3 August, we suggested to you a fair solution in the
meaning of Article 6(3) of Regulation 1049/2001, which provides that “in
the event of an application relating to a very long document or to a very
large number of documents, the institution concerned may confer with the
applicant informally, with a view to finding a fair solution".
As explained in the letter, there are basically two options for such fair
solution: either its scope may be narrowed down to a manageable amount of
documents or the Commission services proceed with the review of all
relevant documents they have identified, but without setting a deadline
for the final reply.
So far we have not received a written reply from you, confirming whether
or not you would accept the proposal and, in the affirmative, which of the
options you would prefer.
We therefore ask you to confirm to us whether you can agree to the
proposal and what your desired option would be by returning e-mail and
using the same e-mail address as the one through which you introduced your
initial application, so that we have a sufficient guarantee of identity.
Please note that the Commission services have been contacted by a third
person claiming to act on your behalf.
However we note that your request, as well as the reply given by the
Commission services, is publicly accessible on the Internet at
[1]https://www.asktheeu.org, so any person may easily make such claims.
You will understand that as a general rule, and especially in the current
situation where the request and reply, including personal and contact
data, the Commission services cannot proceed discussing the further
handling of a request with other persons than the initial applicant.
As any person may introduce requests for access to documents under
Regulation 1049/2001/EC, the persons claiming to act on your behalf is
free to introduce a request that is identical or similar to the one you
introduced.
I would also like to point out that, may you not wish to pursue your
request, you have the option to withdraw it.
I hope to have clarified things sufficiently and invite you to reply to
the letter of Ms Nelen by returning e-mail, preferably within 5 working
days, so that we will be able to proceed with the handling of your
application.
I thank you beforehand for your reply.
With kind regards,
Marianne Muller

Dear Mrs Muller,
I am contacting you concerning the demand I have posted on the website "Ask the EU" dated 12 June (GestDem No 2017/3603).
After the extended time limit for an answer expired on 27 July, Mrs Nellen proposed a fair solution in the meaning of Article 6(3) of Regulation 1049/200 1, which provides that “in the event of an application relating to a very long document or to a very large number of documents, the institution concerned may confer with the applicant informally, with a view to finding a fair solution".
I understood there were two options for such fair solution: either its scope may be narrowed down to a manageable amount of documents or the Commission services proceed with the review of all relevant documents they have identified, but without setting a deadline for the final reply.
I actually agree for narrowing the scope of my demand down to a manageable amount of documents.
My first demand concerned the topics of
-the Circular Economy http://ec.europa.eu/environment/circular...
-Packaging and Packaging Waste http://ec.europa.eu/environment/waste/pa...
-Waste Policy http://ec.europa.eu/environment/waste/in...
-Plastic Waste http://ec.europa.eu/environment/waste/pl...
I asked for all correspondence (including emails), the list of meetings with detailed minutes and any other reports of such meetings between :
-Direction Générale de l'Environnement officials and representatives of the following organisations/persons:
-Coca-Cola Company
-Monsieur Muhtar Kent
-Madame Sophia Chrysopoulou
-Uwe Wolfgang Kleinert
-Plastics Europe
-PET user alliance
All requests above between January 2013 and June 2017
In order to narrow the scope of the demand, I agree to limit the period of time from January 2015 to June 2017.
My new demand still concerns the same topics :
-the Circular Economy http://ec.europa.eu/environment/circular...
-Packaging and Packaging Waste http://ec.europa.eu/environment/waste/pa...
-Waste Policy http://ec.europa.eu/environment/waste/in...
-Plastic Waste http://ec.europa.eu/environment/waste/pl...
I am asking for all correspondence (including emails), the list of meetings with detailed minutes and any other reports of such meetings between :
-Direction Générale de l'Environnement officials and representatives of the following organisations (I narrowed the list compared to my first demand).
-The Coca-Cola Company
-Coca Cola European Partners (CCEP)
-Burson-Marsteller
I hope this narrowed request can be dealt with. I am waiting for your answer.
Yours faithfully,
Francis Carrière
