Penalties notification from regulation (EC) No 715/2007

The request was partially successful.

Dear Madam, Sir,

Under the right of access to documents in the EU treaties, as developed in Regulation 1049/2001, I am requesting documents which contain the following information:

- The content of all member states' notifications of provisions on penalties, as required by article 13 of regulation (EC) No 715/2007, of 20 June 2007.

- The content of all member states' notifications of any subsequent amendments affecting the aforementioned penalties, as required in the same article, sent by member states to the Commission since 2 January 2009.

I'm looking forward to receiving your reply.

All the best,
Peter Teffer

Dear Mr Teffer,

We refer to your three requests for access to documents dated 12/04/2016
and registered on 12/04/2016 under the above mentioned reference numbers.

Your application is currently being handled. However, since the
consultation of documents/files is still ongoing, we will not be in a
position to complete the handling of your application within the time
limit of 15 working days, which expires today (03/05/2016).

Therefore, we have to extend the time limit with 15 working days in
accordance with Article 7(3) of Regulation (EC) No 1049/2001 regarding
public access to documents. The new time limit expires on 30/05/2016.

We apologise for this delay and for any inconvenience this may cause.

Dear Internal Market, Industry, Entrepreneurship and SMEs,

Many thanks for your reply to my request for documents last 30 May 2016, and thanks for granting me access to 22 of the documents.

You wrote that for the rest of the documents, 'third-party consultations' were still ongoing and that I will receive a separate reply with those documents when consultations are done.

Since this batch of 18 documents relates to more than 10 different member states, this may mean that if just one member state is significantly slower in concluding the third-party consultations, all the other documents are held up.

It being 16 June now, I wonder if any third-party consultations have been concluded since your reply to my request on 30 May. If so, could you already send me those documents?

Thanks again,
Peter Teffer

Dear Internal Market, Industry, Entrepreneurship and SMEs,

I'm writing about my access to documents requests GestDem 2016/1933 and 2016/1938.

There are still 8 remaining documents that I have not yet received. It is now 1 September - 142 days since my initial request. Surely the third-party consultations must be over by now.

Please send the remaining documents without delay.

Sincerely,
Peter Teffer

Dear Mr Teffer,

The consultations have been finalised, but  the third reply to your

However, the reply is now ready for signature by the hierarchy and you
will receive it as soon as it has been signed.

Apologise once again for the delay and kind regards,

Dear Mr Teffer,

please find enclosed a reply letter concerning your access to documents
requests GestDem 2016/1933 and 2016/1938, a document register, and the
related documents. This is a follow-up to the replies sent on 30 May 2016
and 21 June 2016. Our apologies for the delay.

As foreseen by Article 297 of the Treaty on the Functioning of the
European Union (TFEU), decisions which specify to whom they are addressed,
shall be notified to those to whom they are addressed and shall take
effect upon such notification. Replies triggering the possibility for
administrative or judicial redress are therefore transmitted via
registered mail with acknowledgement of receipt.

In order to obtain legal certainty as regards the date of receipt of the
reply by the applicant under Regulation 1049/2001,  the following
categories of replies are normally sent via registered mail:

- Negative reply

- Partially negative reply

- Devoid of purpose reply (=no documents found)

- Reply containing documents from which personal data has been redacted

The letter would normally be sent to you via registered mail. However, in
your e-mail of 7 July 2016 you requested to receive only a digital copy of
all future replies.

Thus we consider that the fifteen-day period for making a confirmatory
request starts to run from tomorrow (the day after the reply e-mail is
sent). Please don't hesitate to let us know if you disagree with this and
would like to receive the letter via registered mail after all.
