Policies/provisions for intolerance affecting the rights of citizens

We're waiting for giffy broadstone to read recent responses and update the status.

Dear Council of the European Union,

Under the right of access to documents in the EU treaties, as developed in Regulation 1049/2001, I am requesting documents which contain the following information:

policies/provisions for intolerance affecting the rights of citizens.

In particular, does the EU recognize such things, are there provisions for the same and where does one turn for assistance.

Background: problems with local police. Suspect my non English origin is an issue.

Yours faithfully,

giffy

Dear TRANSPARENCY Access to documents (COMM),

Many thanks for your response. I have a follow up question: where local (uk) police fail to record or investigate crime for discriminatory motive, may one turn to an EU authority? I hold dual Italian/British nationality.

Yours sincerely,

giffy broadstone

Dear Europe Direct Contact Centre,

Many thanks for your message.

My question relates to EC not state matters. I seek not legal advice but rather a copy of the legislation and policy. That's to say, with reference to my last message, please supply or reference the relevant legislative and policy documents.

Hope this clarifies.

Yours sincerely,
GB

TRANSPARENCY Access to documents (COMM), Council of the European Union

1 Attachment

Dear Mr Broadstone,

We regret to inform you that it is not possible anymore for you to file a
confirmatory application with the Council of the EU with regard to your
access to documents request "Policies/provisions affecting rights of
citizens".

Indeed, pursuant to article 7(2) of Regulation 1049/2001 regarding public
access to European Parliament, Council and Commission documents, "In the
event of a total or partial refusal [of access], the applicant may, within
15 working days of receiving the institution's reply, make a confirmatory
application asking the institution to reconsider its position."

The General Secretariat of the Council (GSC) replied to your initial
request for access to documents on 27 January 2021 and invited you, in
order to help you better define the terms and scope of your inquiry, to
consult relevant websites of EU institutions and bodies specialised in
Justice and Fundamental rights.

Regarding the subsequent question you asked by email dated 27 February
2021, the GSC forwarded your request to the Europe Direct Contact Centre,
which

replied on 17 March 2021.

Against this background, we are unable to follow up on your request below:
your confirmatory application is made more than 6 months after the reply
by the GSC to your initial application, which makes it inadmissible.

If you consider that your rights as a victim of crime have been violated,
we cannot but repeat the recommendation that the Europe Direct Contact
Centre made in its reply of 17 March 2021 to you, namely that you need to
address a complaint to the relevant authority in your country of residence
(an ombudsman or an anti-discrimination body) or contact the Italian
consulate for assistance.

For more information about the EU's legal and policy framework for
protecting victims' rights and assisting victims of crime, please consult
the following [1]page of e-justice website and the relevant [2]Commission
website.

Yours sincerely,

Transparency
