Portuguese sanctions for net neutrality vioaltions

Under the right of access to documents in the EU treaties, as developed in Regulation 1049/2001, I am requesting documents which contain the following information:

Under Article 6 of the EU regulation on Telecom Single Market (2015/2120) member states have to laydown penalties for net neutrality violations and notify the commission about these provisions. According to Article 6 this should have been done by April 2016. According to a recent report by BEREC in the case of Portugal this has not happend as of October 2017[1].

Has the commission inquired with the Portugal government why there are still no penalties established under the Portuguese telecomunications law?
Have there been any meeting notes or any correspondence betweent the European Commission and representatives of the Portuguese government concerning this matter?

I am filing the following confirmatory application with regards to my access to documents request 'Portuguese sanctions for net neutrality vioaltions'.

My request for information directly concerns the obligation of the EU commission to ensure that EU law is uphold in the member states. Article 6 of Regulation 2015/2120 creates an obligation for member states to implement penalties for net neutrality violations and notify the commission on such provisions by April 2016. Such provisions have not been adopted in the case of Austria and Portugal. The communication of the Comission with those member states not in compliance with EU law is the subject of my freedom of information request. Please ensure that my right to freedom of information is respected. This is an urgent matter.

Regulation (EC) No 1049/2001 regarding public access to European
Parliament, Council and Commission documents (‘Regulation 1049/2001’).
