Dear Internal Market, Industry, Entrepreneurship and SMEs,

Under the right of access to documents in the EU treaties, as developed in Regulation 1049/2001, I am requesting documents that contain the following information:
I am a non-EEA specialised doctor with acquire rights in the UK.
In this country, there has been the common practice that those EEA doctors with medical speciality qualifications who might want to be academics for Universities have to do another period of training.
Then, I wonder once the automatic recognition of their medical speciality qualifications have been granted by the Directive 2005/36/EC, member states, such as the UK are entitled to keep treating them as trainees rather than specialised doctors just because they want to
pursue academic positions at Universities, asking them to keep doing training.
The statutory body in the UK (the GMC) has argued that academic (not standard) training is not recognised by the 2005/36/EC, therefore, they are entitled to apply the general system for this programme, meaning compensatory measures, such as an additional period of training

Dear Sir,

We refer to your mails dated 21/10/2020, 27/10/2020, 16/11/2020 and
18/12/2020 in which you make a request for access to the name of the
person who signed the letter, in reference with the reply of our unit to
your request for information regarding post qualifications. Your email
cannot be considered a confirmatory application as it refers to a request
for information, not an access to document request.

Having examined your request under Regulation (EC) No 1049/2001 and
Regulation (EU) 2018/1725 (hereafter, Data Protection Regulation), I
regret to inform you that your request cannot be handled.

Article 9(1)(b) of the Data Protection Regulation does not allow the
transmission of personal data, except if you prove that it is necessary to
have the data transmitted to you for a specific purpose in the public
interest and where there is no reason to assume that the legitimate
interests of the data subject might be prejudiced. In your request, you do
not express any particular interest to have access to these personal data
nor do you put forward any arguments to establish the necessity to have
the data transmitted for a specific purpose in the public interest.

Consequently, I conclude that, pursuant to Article 9(1)(b) of the Data
Protection Regulation, your request formulated in relation to an
identified, or identifiable, natural person cannot be handled, as the need
to obtain access to the personal data resulting from the handling of your
request, for a specific purpose in the public interest, has not been
substantiated and there is no reason to think that the legitimate
interests of the individuals concerned would not be prejudiced by
disclosure of the personal data concerned.

I would kindly ask you to lead an internal review about the reasons behind why it has been the European Commission has refused to provide me with the name of the author of the letter sent by them to me.
They argued Article 9(1)(b) of the Data Protection Regulation for not providing that information.
That is wrong
Article 9 protects the transmission of personal information from others, not from the author of the requested information
This makes no sense. thus, please provide what it was requested

Please pass this on to the person who reviews confirmatory applications.

I will attach you what the Information Commissioner's Office (ICO) says
What is the definition of ‘recorded information?
A request for a copy of a document is a valid request for all the ‘recorded information’ in that document.

‘Recorded information’ can be defined as any feature or characteristic of a document that imparts information or knowledge to the viewer.

This means that the term ‘recorded information’ doesn’t just apply to the text; it covers any component of the document that conveys information, for example:

Design and layout: this can reveal something about the nature of the document. For example, whether it is recorded in the form of a report, spreadsheet or letter.

Logos and letterheads: these can tell the viewer something about the authenticity and legitimacy of the document.

Emphasised wording: the use of underlining, italics or bold font tells the viewer something about the significance of the emphasised words.

Annotations and headers and footers: this includes handwritten and electronic comments, markings such as crossed out or circled words and annotations made outside the main body of the text. Any text in headers and footers also qualifies as information recorded in the document.
Images: images such as diagrams, photographs and pie charts usually convey some form of information to the viewer.
Email transmission details: the time and date of transmission and electronic signature are part of the recorded information in an email.

Handwriting: this includes both the writer’s HANDWRITING AND THEIR SIGNATURE
