Reach revision + DG Grow
Dear Internal Market, Industry, Entrepreneurship and SMEs,
Under the right of access to documents in the EU treaties, as developed in Regulation 1049/2001, I would like to request access to the following documents related to the Chemical Strategy for Sustainability, and in particular to the reform of the CLP and REACH Regulations:
1. A list of all meetings/ discussions that have taken place since 1st December 2021 between Commissioner Breton and representatives of his cabinet (in particular Gaelle Garnier, Joan Canton and Valere Moutarlier), the directors and the director-general of DG GROW, with representatives of individual companies (including their lobby consultancies and law firms) and/or industry associations on the other hand, specifically: BDI, VCI, CEFIC, Eurometaux, Bayer, BASF, PlasticsEurope, Corteva, 3M, Chemours, Corbion, Solvay.
2. Any records, minutes or notes of these meetings/discussions.
3. Any briefings prepared for these meetings.
4. All correspondence exchanged since 1st December 2021 (including SMS & any other type of messages processed through phone apps - eg., WhatsApp, Signal, Telegram etc, recorded voice messages, emails, letters and attached documents) between the above DG GROW officials and representatives of individual companies (including lobby consultancies and law firms) and/or industry associations on the other hand.
In the interests of good administration, I request that the response clearly identifies the documents held by the Commission in relation to each of these categories and clearly indicates to which category the disclosed documents relate.
To the extent possible, my strong preference is to receive documents in electronic format

Dear Madam,
We are writing concerning your request for access to Commission documents
registered on 10/10/2022 under case number 2022/5754.
We are currently working on your request. However, we have not yet been
able to gather all the elements necessary to carry out a full analysis of
your request. We will not be able to send you the reply within the
prescribed time limit expiring on 31/10/2022.
The application concerns a very large number of documents ; part of the
documents requested originates from third parties, which have been
consulted and the application concerns documents held by different
Services, which must be consulted.
Therefore, in line with Article 7(3) of [1]Regulation (EC) No 1049/2001,
we need to extend this time limit by 15 additional working days. The new

I am filing the following confirmatory application with regards to my access to documents request 'Reach revision + DG Grow' 2022/5754.

Please note that I do not expect or wish to receive personal data. However, several documents including the note of the BDI breakfast and the briefing for the Chemours meeting have substantial redactions. It is not clear from the letter why they have been readcted. The table intimates that this could be because the redacted information was "out of scope". I would be grateful for confirmation that this is indeed the case and that none of the redacted info is relevant to my request.
Furthermore I was surprised that only 8 documents were found. I have not heard from you regarding my confirmatory application to 2022/5754 since 27 January. It it is not acceptable to have no updates nor responses. I consider the Commission is in complete violation of Regulation 1049 which only allows for one extension of 15 days in “exceptional circumstances” with “detailed reasons”.
If I don’t receive a substantive reply by Friday 26 May I will take a complaint to the Ombudsman.
