Records of Case C 494/01-Commission v Ireland closed 22 October 2015 relating to Ispat Steel and Haulbowline Island, County Cork.

Dear Environment,

Under the right of access to documents in the EU treaties, as developed in Regulation 1049/2001, I am requesting documents which contain the following information:
On 30 September 2010 the cleanup of Haulbowline Island’s East Tip from the operations of Ispat Steel in Cork Harbour Ireland was joined to the follow up on the 2005 Waste ECJ Judgment against Ireland [Judgement of the Court of Justice of the European Communities in Case C 494/01-Commission v Ireland dated 26 April 2005]. This case was subsequently closed on 22 October, 2015. Can we please have in electronic format all relevant documents relating to the regularisation and clean up of Haulbowline Ireland, including all correspondence between the Commission and Ireland, and specifically any correspondence relating to the extension of the East Tip clean-up to an ‘all island’ approach announced by the Minister for Agriculture, Food and the Marine, Simon Coveney T.D on 8 January 2016. This request is limited to that portion of the follow up to the judgment of Haulbowline Island only and no other part of the Case C 494/01 and is for electronic copies of any relevant records.

I am writing to request an internal review of Environment's handling of my FOI request 'Records of Case C 494/01-Commission v Ireland closed 22 October 2015 relating to Ispat Steel and Haulbowline Island, County Cork.'.

There is no copy of the electronic record of the PILOT communications between the member state and the Commission which records responses and questions between the parties. This document is key to ensuring that the full record of these communications is provided.

There is no copy or mention of our own initial submission triggering the PILOT case or our 2011 submission seeking an extension of the clean-up of this site from 9 hectares to 21 hectares or the direct actions triggered by these submissions.

There is no record of the EU site visit or the meetings held at that time (2011) with Mr. Breakman, the then Head of the Compliance Unit.

We have no confidence, therefore, that the full record of this case has been provided to us.
