Refused registration to Access to Documents requests

Response to this request is long overdue. By law, under all circumstances, European Data Protection Board should have responded by now (details). You can complain by requesting an internal review.

Mathias Schindler

Dear European Data Protection Board,

I am requesting a copy of each Access to Documents request from 2018 and 2019 that was refused registration because the requesting person did not provide a postal address.

Please do not transfer this request to another authority, I am specifically asking for requests that were sent to you.

I am perfectly fine with the redaction of personal information.

Since my postal address is on file and there is no legal requirement for a provision of a postal address (and since the European Commission has stopped sending out physical letters in Access to Document request procedures during the pandemic anyway) please do not bother asking me again for a postal address, which yould be especially hillarious given the topic of this request, don't you think?

Yours faithfully,

Mathias Schindler

Dear European Data Protection Board,

Article 7 (1) of Regulation 1049/2001 requires you to process my request promptly. I was under the impression that the registration has already happened on June 5 when you sent me the email. Could you please explain this discrepancy in time which affects your calculated deadline?

Yours sincerely,

Mathias Schindler

European Data Protection Board

Dear Mr. Schindler,

I suppose you refer to the automatic reply that you received on June 5, after sending your e-mail to the EDPB. That is an automatic reply and, as such, does not qualify as a registration of your request for access to documents.

The registration of your request took place on 12 June, as we informed you in our e-mail. The 15 days deadline starts running from the moment the application is registered, as per Article 7(1) of Regulation 1049/2001 on access to documents. Therefore, the deadline to reply to your request is 3 July 2020.

Best regards,
The EDPB Secretariat
