Thank you for your e-mail sent on 22 June 2022, in response to my access to documents request which was registered on 31/05/2022 under reference number GESTDEM 2022/3144.
It seems that there is a misunderstanding about the content of my request. If you are able to send a new reply that deals with this misunderstanding, that would have my preference. If that is not possible, please consider this to be a confirmatory application, and please pass this on to the person who reviews confirmatory applications.
In your reply to my application, you quoted article 4.1 from the Decision setting up the Regulatory Scrutiny Board, which deals with the disclosure of "any potential conflict of interest with respect to a particular report". You stated that the procedure referred to in this article "has never been applied so far" and that thus "the Commission does not hold any documents" that correspond to my request.
But my request related to the declaration on the commitment to act independently in the public interest, which members are required to make BEFORE taking office. The requirement cited in article 4.1 deals with specific reports, while the requirement I referred to is one of a general nature.
This requirement is cited in vacancy notices such as the 'Publication of a vacancy for a Member of the Regulatory Scrutiny Board at grade AD 14 (Principal Adviser)' published in the Official Journal of the European Union on 11.12.2020 (COM/2020/10398 - (2020/C 428 A/01)). This vacancy says literally:
"Independence and declaration of interests
Before taking up his/her duties, the Principal Advisor will be required to make a declaration of commitment to act independently in the public interest and to declare any interests, which might be considered prejudicial to his/her independence."

I refer to my confirmatory application for access to documents which was registered on 24/06/2022 (Ares(2022)4632376), and your decision to extend the time-limit to reply.
Article 8.2 of Regulation 1049/2001 says: "In exceptional cases, for example in the event of an application relating to a very long document or to a very large number of documents, the time limit provided for in paragraph 1 may be extended by 15 working days, provided that the applicant is notified in advance and that detailed reasons are given."
An extended time limit is thus only possible in "exceptional cases" and when "detailed reasons are given".
The only (not very detailed) reason you have now given me for the need to extend the time limit is that you "have not yet been able to gather all the elements needed to carry out a full analysis of your request and to take a final decision". Gather all the elements needed to carry out a full analysis of a request are part of the standard work of handling an access to documents request, which the regulation requires is done within 15 working days.
Can you explain why you believe that reason to qualify as "detailed reasons" that show my application is an "exceptional" case?

In that e-mail you tell me:
"In this case, the review includes the assessment of your confirmatory request, the identification of possible documents falling under the scope of your requests and, as the case may be, the assessment of those. Furthermore, the procedure until the adoption of the confirmatory decision requires the consultation of the services, including of the Legal Service, in order to be signed by the Secretary General. But this description of events is not specific to my case. ALL confirmatory applications require the assessment of the confirmatory request, the identification of possible documents falling under the scope of your requests and, as the case may be, the assessment of those, as well as consultation of the services and a signature.
You cannot argue that my case is an exceptional cases, by describing a regular case. You have thus not provided me with "detailed reasons" to show my application is an "exceptional" case.

On 6 October 2022, you acknowledged the handling of my request was indeed overdue. Although I of course accept your apology, it is difficult to be "assured" that you are working on the final discussion, as you claimed, when another month goes by.
Another apology is not necessary, but rather, I would appreciate it if the Commission adhered to the rule of law by respecting the time limits from Regulation 1049/2001.
