Under the right of access to documents in the EU treaties, as developed in Regulation 1049/2001, We are requesting documents which contain the following information:

Documents related to the annual European Day for Border Guards Photo Competition (2010 till 2020):
1) Calls for submission of the photo competition of all previous editions as well as the coming edition in 2021, in pdf.
2) All photographs that did “not comply with the technical or artistic specifications or legal requirements”, as described in “EBCG Day 2019 Photo Competition Terms and Conditions”, nr 34.,p3/3
3) All photographs that were selected by the jury including name, caption and title of the photograph.
4) Documents with records (minutes) of the “Selection Panel[s]” arguments and statements (relating but not limited too), both for and against:
— Selection for exhibition
— Selection for 1st, 2nd and 3rd Price
— “relevance of the photo to the competition theme, originality, creativity expressed, as well as photographic ability.” as described in “EBCG Day 2019 Photo Competition Terms and Conditions” nr17, p2/3
5) Documents related to announcements, the planning of the spacial setup and change in policies related to the European Day for Border Guards Photo Competition.

I am filing the following confirmatory application with regards to my access to documents request 'related to the EBCG Day Photo Competition'.

August, 27. 2020 I request documents.
On September 21. 2020 a pad case was created.
On mutual agreement processing was delayed.
On the 07/10/2020 i received a reply from the PAD offices that the "Further to your request of 29 September 2020, this application is now being processed."
In the same message it was requested to split the request in four seperate request — if you have to do this, please do.
Under the right of access to documents in the EU treaties, as developed in Regulation 1049/2001 it is demanded — nevertheless of the timespann the request takes — that the request is proessed with constant commitment — which also has been announced by your employees.

Since today i am waiting for any results/documents of this processing.
A further request on this occasion on November, 19. 2020 has been ignored.
On a further request on the 05/01/2021 you referred back to the message of the 7 October 2020.

Since October 7 2020 your trancparency office had 75 working days which allows to process 62.5% of the request — even with splitting them into 4 requests and with Regulation (EC) No 1049/2001 being applicable to each individual application.

Therefore i kindly ask you to deliver the documents so far collected for this request as soon as possible.
And proceed with collecting the further 37.5% of it within the remaining given timeframe of 45 workingdays.

Dear Frontex Transparency Office,

apparently there has been a misunderstanding: If you don't supply me with at least two possibilities to an action, no approval/denial on the suggestion is required to proceed. No suggestions from my side where asked for. Your initial reply didn't formulate a request, it lined out a proceeding. Even if you would have expected a reply from my side, this could have been further processed until I reply. — I kindly ask you to explain why this proceeding hasn't been processed from your side even though you had approved the initial request. And — for further feasible communication — layout clearly when you stop collecting documents until you receive a reply. This was not made clear in your information from the 7th of October.

If there was any misunderstanding: I expected you by the 7th of October to split the application into four different applications and proceed your work.
Herewith i therefore kindly ask you — starting form today, 2.2.2021, deliver the requested documents as soon as possible.
To find a for both sides acceptable solution I propose to you to split the application into four parts but with no extension of deadline as laid out in Regulation (EC) No 1049/2001 7(3.).

I herewith also ask you to already start collecting those as of today — even if you still have concerns or counterproposals to formulate regarding the deadline of delivering the documents .

If you would be so kind to clearly confirm that you by now, have been started again processing this case, no confirmatory application will be necessary.
