We refer to your e-mail dated 8 May 2017 in which you make a request for
access to documents, registered on 22 May 2017.

 

Your application is currently being handled. However, we will not be in a
position to complete the handling of your application within the time
limit of 15 working days, which expires on 1 June 2017.

 

An extended time limit is needed as your application relates to documents
originated from third parties which have been consulted.

 

Therefore, we have to extend the time limit with 15 working days in
accordance with Article 7(3) of Regulation (EC) No 1049/2001 regarding
public access to documents. The new time limit expires on 23 June 2017.

Having examined the documents requested under the provisions of Regulation
(EC) No 1049/2001 regarding public access to documents, I have come to the
conclusion to grant access to documents No. 9, 10 and 11.

To the contrary, documents No 1, 3, 4, 15, 16, 19, and 22 may be only
partially disclosed. Finally, for documents No. 2, 5, 6, 7, 8, 12, 13, 14,
17, 18, 20, 21 access shall be refused.

As regards documents No 1, 3, 4, 15, 16, 19, and 22 part of the content
has been blanked out as the disclosure is prevented by exceptions to the
right of access laid down in Article 4 of this Regulation.

The redacted parts of the documents contain:

i)      information related to the surface occupied by the Agency, which
is protected by the public interest as regards public security;

ii)     personal data of individuals, and

iii)    commercially sensitive business information of the Contractor.

Disclosure of those parts indicated above at i) would undermine the
protection of the public interest as regards public security, in so far as
it would reveal the positioning of the Agency within a shared building as
well as it would provide indications as to where sensitive rooms are
located. It would also provide information as regards the parking area of
the Agency, exposing the staff of the Agency and other individuals to
security risk. I shall, therefore, refuse access pursuant to Article
4(1)(a) of Regulation 1049/2001 to those information.

Disclosure of the parts indicated above at ii) would undermine the
protection of the privacy and integrity of the individual related to
individuals working with the Contractor. As a result I shall refuse access
pursuant to Article 4(1)(b) of Regulation 1049/2001 to those information.

Finally disclosure of those parts indicated above at iii) would, instead,
undermine the commercial interests of the Contractor, in so far as it
would disclose its pricing strategies in a highly concentrated market from
both supply and demand side. As a result I shall refuse access pursuant to
Article 4(2) of Regulation 1049/2001 to those information.

The exceptions laid down in Article 4(2) of Regulation 1049/2001 apply
unless there is an overriding public interest in disclosure of the
documents. After having assessed whether such an overriding public
interest exists, I came to the conclusion that making the content of the
documents public does not outweigh the harm that disclosure would cause to
the interest protected by Article 4(2) of Regulation 1049/2011.

However, in order to balance the right of access together with the
prerogatives of third parties, documents No. 1, 3, 4, 15, 16, 19, 22
contain ranges as regards square meters and amounts in Euro so that it is
possible to see the evolution in the expenditures and areas covered by the
Agency’s premises. Please consider that additional information concerning

As regards the documents No. 2, 5, 8, 12, 14, 17, 18, 20 and 21, the
considerations reported above related to point i) and iii) apply and
therefore I shall refuse access to the full document. Access to the
remaining part of the documents, after the redaction of the relevant
parts, would make their content meaningless.

As regards the documents No. 6, 7 and 13, the considerations reported
above related to point iii) apply. The same applies also to document No.
12, as disclosure would undermine the commercial interest of third
parties. I shall therefore refuse access to the whole documents. Access to
the remaining part of the documents, after the redaction of the relevant
parts, would make their content meaningless.

In accordance with Article 7(2) of Regulation 1049/2001, you are entitled
to make a confirmatory application requesting the Agency to review this
position.

Such a confirmatory application should be addressed within 15 working days
upon receipt of this letter to the Director of the Agency at the following
