I am writing to request an internal review of Neighbourhood and Enlargement Negotiations's handling of my FOI request 'reply to Danish authorities - Hague adoption convention'.

It is hard to believe that the document I requested does not exist.

The below is from a 2007 webpage of the Danish adoption agency DanAdopt. It is no longer online, but I had filed it.

"We start to turn the clock back to the autumn of 2005, when the NAC was represented at a conference in The Hague, whose purpose was to discuss the practical application of the Hague Convention in both deliver-as beneficiary. Here presented a representative of the EU Commission of the Commission's views, and we were to say the least surprised when she particular expressed the view that international adoption should be seen as the absolute last resort. This was quite contrary to the way we think and work and which we believe is the correct interpretation of the Hague Convention, namely that it is in the best interests of the child to be part of a family rather than being placed in an institution in its home country. Subsequently, we encountered similar views expressed by various parties in the EU system, including from an English member of the European Parliament, Baroness Emma Nicholson, who has been closely involved in the process of the accession negotiations with Bulgaria and (especially) Romania. In the recent past, the EU Commission replied to a question from the Danish authorities, which bl.a.hedder that international adoption can only be considered if there is no appropriate way to take care of the child's country of origin. Later in the response goes on to express that, in general, in Romania and Bulgaria are the adequate care here, why the Hague Convention does not oblige the 2 countries to release children for international adoption. The Swedish authorities have received the reply from Brussels that there is no EU decision on international adoptions. Confused? "

The same Danish adoption agency sent a letter to the Danish European Commissioner in 2007, which also refers to the same letter of DG Enlargement. This letter was made public last year

I also in 2007 got a private copy of that letter, but would appreciate if the European Commission can make it accessible to the public under Regulation 1049/2001.

Intrigued by the fact that this letter seems difficult to find, I hereby also request access to the letter addressed to the Swedish authorities (as mentioned in the DanAdopt text). Unless you want me to make a separate request for that.
