submitted to ESMA on 28 August 2022 pursuant to Regulation (EC) No
1049/2001. In particular, you requested ESMA to get access to the
following: " Report published by the European Securities Markets Expert

Perimeters of FSAP Directives (6 May 2008). The report we previously

Preliminarily, we would like to draw your attention to the fact that the
requested document dates back to more than 10 years ago, hence before the
establishment of ESMA and was drafted by the European Securities Markets
Expert Group (ESME), an expert group established by the EU Commission. In
this context, please note that, further to the research carried out by the
relevant Departments of ESMA (also in the archives of CESR, the legal
predecessor of ESMA), we would like to inform you that ESMA does not
possess the requested document.
 
We advise you to contact the EU Commission in this respect.
