3. Any other documents in the Council’s possession that record the positions of the Member States, the Council and/or the Commission in relation to the Commission’s Proposal for a Council Regulation fixing for 2023 the fishing opportunities for certain fish stocks and groups of fish stocks, applicable in Union waters and, for Union fishing vessels, in certain non-Union waters (interinstitutional file 2022/0343 (NLE)), including documents dated after the December Council 2022. For the sake of clarity, this includes any scientific and/or economic evidence and/or arguments used and/or referred to as well as preparatory and supporting documents and any exchanged correspondence.

This request does not include documents that are already fully publicly accessible in the Council’s document register on the date of this request.

We urge you to take due account of the judgment of the General Court of the Court of Justice of the European Union in Case T-163/21 – Emilio Di Capitani vs. Council of the EU, in which the Court held that documents drawn up and exchanged within the Council working groups in the context of a legislative procedure are legislative documents and thus they must be made available to the public: “it should be recalled that, in a system based on the principle of democratic legitimacy, co-legislators must be answerable for their actions to the public. If citizens are to be able to exercise their democratic rights they must be in a position to follow in detail the decision-making process within the institutions taking part in the legislative procedures and to have access to all relevant information” (para. 84 of Case T-163/21).

Finally, we request that the documents/information falling within the scope of this request be made publicly available on the Council’s documents register, in accordance with Articles 11 and 12 of Regulation 1049/2001 and Article 4 of Regulation 1367/2001. In this context, we reiterate the Decision of the European Ombudsman in case OI/4/2020/TE.
