Dear Permanent Representation of Czech Republic to the EU,

Under the right of access to documents in the EU treaties, as developed in Regulation 1049/2001, I am requesting documents which contain the following information:

-All correspondence (letters, emails, etc) and minutes of meetings (or any other reports of such meetings) where the EU criteria for the identification of endocrine disrupting chemicals (more info to be found here: https://ec.europa.eu/health/endocrine_di... ) were discussed between officials of the Permanent Representation of Czech Republic to the EU and representatives of (one or more of) the following companies/organizations:

-Bayer
-BASF
-Dow Chemical
-DuPont
-DowDuPont (after merger)
-Syngenta
-Monsanto
-European Crop Protection Association (ECPA)
-European Chemical Industry Council (Cefic)

(between June 1st 2016 and August 1st 2018).

Dear Mr. Harmsen,

on 8th August we have received your request for information regarding
potential discussion (in person or via email) about the criteria for the
identification of endocrine disrupting chemicals between representatives
of the Permanent Representation of the Czech Republic to the EU and the
stakeholders mentioned held between 1st June 2016 and 1st August 2018.
Your request refers to the Regulation (EC) Nr. 1049/2001 of the European
Parliament and of the Council regarding public access to European
Parliament, Council and Commission documents.

The Regulation Nr. 1049/2001 formulates principles, conditions and limits
for the right of access to documents of the institutions (Art. 1 a)).
Thus, the scope of the Regulation is limited only to the documents of the
institutions (i.e. documents drawn up or received by them, Art. 2).
Accordingly, there is no obligation for any Member State stemming from the
Regulation Nr. 1049/2001.

Nevertheless, being committed to the principle of transparency, we will
provide you with the information requested:

On 10th February 2017 a meeting with the representatives of ECPA and Cefic
was held in the premises of the Permanent Representation of the Czech
Republic to the EU. The main reason for the meeting was to present the
position of both stakeholders to the Commission´s Proposal for Endocrine
Disruptors Criteria that was being negotiated at that time (for details
see documents enclosed). The procedural steps necessary for formulating
the national position were also discussed. No official minutes of the
meeting exist.

Please find enclosed an email requesting a meeting from ECPA and Cefic and
letters sent to the European Commission containing their positions that
was presented during the above mentioned meeting.
