Request for emails on data transfers from EU to US

Response to this request is long overdue. By law, under all circumstances, Secretariat General of the European Commission should have responded by now (details). You can complain by requesting an internal review.

Dear Secretariat General of the European Commission,

Under the right of access to documents in the EU treaties, as developed in Regulation 1049/2001, I am requesting documents which contain the following information:

ALL EMAILS held by the European Commission containing any of the following keywords in the subject line or text of the message:
1) "Safe Harbour"
2) "Safe Harbor"
3) "Privacy Shield"
4) "transatlantic data flows"

The European Commission needs to search its entire email system, including UNREGISTERED EMAILS. The date range for the search is from October 8, 2016 to April 8, 2017.

Since the unregistered emails are now subject of a formal request to access public documents, the European Commission needs to immediately stop the automatic deletion of these unregistered emails. The European Commission needs to preserve these unregistered emails to enable access to public documents, including during the appeals process.

Yours faithfully,

Rachael Tackett

Secretariat General of the European Commission
