Schrems v DPA Ireland, C-362/14
Dear European Parliament,
Under the right of access to documents in the EU treaties, as developed in Regulation 1049/2001, I am requesting documents which contain the following information:
Transcripts and legal pleadings for the case Maximillian Schrems v. Data Protection Commissioner, Ireland case no. C-362/14.
From the CJEU Registry, it appears that the European Parliament filed legal pleadings in the court case. The European Parliament likely has copies of court transcripts and legal pleadings by other parties in the court case.
Yours faithfully,
Rachael Tackett

Dear European Parliament,
Please pass this on to the person who reviews confirmatory applications.
I am filing the following confirmatory application with regards to my access to documents request 'Schrems v DPA Ireland, C-362/14'.
The EU Parliament only responded with several documents in response to my request. The EU Court of Justice's registry lists 61 documents in the case C-362/14. The European Parliament has failed to release all the public documents in its possession in violation of Regulation 1049/2001.
A full history of my request and all correspondence is available on the Internet at this address: https://www.asktheeu.org/en/request/schr...
Yours faithfully,
Rachael Tackett
OUR REF A(2017)8793
Dear Ms Tackett,
The European Parliament acknowledges receipt of your application for access to documents under Regulation (EC) No 1049/2001. Please note that the application received the following reference number: A(2017)8793.
Parliament understood the initial application with the reference A(2017)5034 as concerning the legal pleadings of Parliament in the case 'Schrems v DPA Ireland, C-362/14'. On 12 June 2017, it published and sent you the pleadings in question, as well as to the pleadings of the European Commission since Parliament noted you were also seeking access to those pleadings. Parliament then considered that your request had been handled and the filed close.
The application you sent us today 12 July 2017 at 05:12 am (Brussels time) cannot be considered as a valid confirmatory application. First because the initial request with the reference A(2017)5034 was closed on 12 July 2017. Second, because the 15 working day time limit to challenge the initial response expired on 3 July 2017, in accordance with Article 7(2) of Regulation (EC) No 1049/2001.
Therefore, Parliament will treat this application as a new initial application, with the reference number A(2017)8793. You will receive a reply to your application within 15 working days.
Best regards,

The European Parliament has released written observations in the Schrems v. DPC Ireland, C-362/14 case. The court's ruling in this case struck down the adequacy decision and thereby invalidated the US-EU Safe Harbor framework.
