a request. Your request was perceived as a request for info initially and
we expected clarifications from your part in order to treat it.
Moreover, the description given in your application does not enable us to
identify concrete documents, which would correspond to your request.

(EC) No 1049/2001 regarding public access to documents, to provide us with
more detailed information on the documents you request, such as
references, dates or periods during which the documents would have been
drawn up, persons or bodies who drafted the documents etc.
Please note that the Commission Regulation (EC) No. 2257/94 is no longer
in force. It was repealed by the current marketing standard for bananas
(Commission implementing regulation (EU) No 1333/2011 of 19 December
2011). The Regulation (EC) No. 2257/94 dating 26 year ago, the
negotiations with Member States are even older.

Dear Access to Documents team,

thank you for your message. I will clarify my request. I am asking for communications with stakeholders in the process of drafting the Regulation, including minutes of meetings with company and trade association representatives (i.e. lobbyists) as well as letters, position papers and other documents from such persons or groups, such as submissions to stakeholder consultations. The time frame should be from the first public proposal of the law until its adoption.

I am aware that the Regulation has been superseded in the meanwhile.

Your application is currently being handled. However, we will not be in a
position to complete the handling of your application within the time
limit of 15 working days, which expires on 12/05/2020.

An extended time limit is needed as in order to retrieve the documents
requested, large files have to be examined.

Therefore, we have to extend the time limit with 15 working days in

I am filing the following confirmatory application with regards to my access to documents request 'Stakeholder communication on Commission Regulation (EC) No. 2257/94'.

After first filing a request in December 2019, I received a partial reply in early June which gave me access to 29 out of 41 documents. The other documents originate from national authorities. I was told that they have been consulted and I would receive a reply as soon as they respond.

First of all, I would like to know whether replies have been sent. If so, I would like to ask for the replies to be passed on. Also, I would like to note that in a reply to a separate request under German law I was told that the Ministry of Agriculture did not receive any request for consultation with the EU Commission (see link to exchange below). I would like to inquire whether the requests for consultation have actually been send in all cases.

Your confirmatory request has been registered by SG. However, we continue the treatment of the request which is still open at our level.

As we informed you in our letter of 02/06/2020, 12 of the identified documents originate from National Authorities and in such cases we are obliged to make consultations.

Please note that the consultations with the Member States are always sent to the Permanent Representations of each country which subsequently contact the National Authorities. All the consultations have been sent but we are still waiting for some replies. Sometimes the consultations last more than expected. We are sorry for this delay.

I can assure you that we are doing our best to send you our second reply as soon as possible. You will be informed once we receive all of them.
