The request was partially successful.

Dear Madams & Sirs,

developed in Regulation 1049/2001, I am requesting documents which contain the following information:

1) a list of meetings of DG Trade officials and/or representatives (including the Commissioner and the Cabinet) and representatives of individual companies and/or industry federations such as BusinessEurope, the European Services Forum (ESF), the Federation of German Industries (BDI) and/or law firms such as Freshfields, White & Case, Herbert Smith and Sidley, in which the EU's foreign investment policy, including the EU-US and EU-Canada investment policy was discussed (since 1 January 2014);

2) minutes and other reports of these meetings;

3) all correspondence (including emails) between DG Trade officials and/or representatives (including the Commissioner and the Cabinet) and representatives of companies, business associations and law firms, in which the EU's foreign investment policy, including the EU-US and EU-Canada investment policy was discussed (since 1 January 2014).

Please note that this request does not relate to the contributions to the Commission's ongoing consultation on ISDS in TTIP, via the respective online tool (as these contributions will be made public anyways).

Yours faithfully,

Dear Laura,
dear Madams & Sirs,

as two weeks have passed since I last heard from you and you suggested that the response to my request would be sent last week, I was wondering if you could please send me another update, including an exact date for when I can expect the publication of documents.

Thank you for your understanding.

Yours faithfully,

Dear Pia,
The file 2015/3817 is still being finalized. We are facing a problem in the management of the AtD requests due to the huge number of requests received lately.
Your file is one of the priorities, being the deadline already expired. I hope you will receive it by next week but with the Easter break approaching and the permanency in the DG I am not able to give you the exact date.
Feel free to contact me for any further information.

Laura

Dear Madams and Sirs,

by online form dated 9 July 2014, Corporate Europe Observatory requested access, on the basis of Regulation 1049/2001 and the Code of Good Administrative Behaviour, to a list of stakeholder
meetings, which DG Trade officials held to discuss EU investment policy, between 1 January and 9 July 2014. We also requested related minutes and correspondence.

By online form of 26 August 2014, DG Trade informed CEO that the application was correctly registered and would be dealt with within 15 working days.

After that date, six messages were sent to CEO (the latest on 25 March 2015) in which the Commission consistently promised a timely reply to CEO.

To date, notwithstanding the expiration of all the time limits set by Regulation 1049/2001 and several assurances of imminent decision on access, the European Commission has neither granted access to
the requested document nor has it written to CEO denying total or partial access thereto.

In these circumstances, CEO requests to the Commission to reply to its application of 9 July 2014 by Tuesday, 19 May 2015 (so, two weeks from now).

Otherwise CEO may activate the procedure laid down in Article 7(4)of Regulation 1049/2001.

Yours faithfully,

Pia Eberhardt
