Study for impact assessment NGT
Dear Secretariat General of the European Commission,
Under the right of access to documents in the EU treaties, as developed in Regulation 1049/2001, I am requesting documents which contain the following information:
1. any (draft) study made to suppor the (draft) impact assessment by the European Commission on legislative initiatives regarding New Genomic Techniques (NGTs) (also called New GMOs)
2. any correspondence between the European Commission (any DG or Commissioner) and any consultant involved in such study referred to under 1.
I note that usually the Commission only publishes the IA when the final legislative proposal is published. However, I note the Judgment of the Court of Justice of the European Union of 4 September 2018 in Case C-57/16 P in which the Court held that documents drawn up in the context of an impact assessment procedure for a legislative proposal constitute legislative documents that should be made directly accessible to the public pursuant to Article 12(2) of Regulation No 1049/2001 before the proposal and that access should not be denied on request.
The topic of the deregulation of new genomic techniques is of great public interest, because the Commission's plan as it stands would weaken environmental and food safety standards, and delete consumers freedom of choice regarding GMOs. The process followed by the Commission so far is highly biased and goes against its own Better Regulation standards, as has been communicated extensively to the EC.
