Subject lines for emails sent between Anders Tegnell and Mike Catchpole
Dear European Centre for Disease Prevention and Control,
Under the right of access to documents in the EU treaties, as developed in Regulation 1049/2001, I am requesting documents which contain the following information:
I would like to retrieve all subject headlines for emails sent between Anders Tegnell and Mike Catchpole during the year 2020.
To clarify I'm requesting the subject lines of the emails not the content.

To be able to conduct the research, ECDC needs to process personal data
which might be included in the correspondence between Mike Catchpole and
Anders Tegnell. Personal data is a broad concept that might for example
cover a personal opinion expressed informally on a specific topic, and can
include even the subject line of an email (which is what you are
requesting).
Processing of personal data requires a legal basis. When access is
requested to documents containing personal data, Regulation (EU) No
2018/1725 becomes fully applicable. According to Article 9.1(b) of this
Regulation, personal data shall only be transferred to recipients if the
recipient establishes the necessity of having the data transferred to them
and if there is no reason to assume that the legitimate rights of the
persons concerned might be prejudiced. When you introduced your request,
you (as recipient) did not establish why the transfer of the personal data
would be necessary. We would like to point out that in accordance with the
judgment of the Court of Justice of the European Union in case C‑127/13 P,
Strack v Commission , a general interest of the public in obtaining access
to documents cannot be equated with a need to obtain personal data.
Furthermore, the requirement to establish the necessity of the transfer of
personal data applies regardless of the fact that the access request forms
part of a journalistic enquiry (see judgment of the General Court in
Joined Cases T-639/15 to T-666/15 and T-94/16, Psara et al. v European
Parliament).
We have also noticed that your application is vague as it does not refer
to any specific topic and might entail a very large number of documents.
In accordance with art. 6.3 of Regulation 1049/2001, we would like to
approach you to find a fair solution by asking you to narrow the scope of
the application to specific topics, which we invite you to list. At the
same time, we give you the possibility to provide to ECDC your arguments
establishing the necessity of the transfer of personal data. Note that if
you are not able to establish the transfer (including if you simply do not
provide any argument on this respect, as you didn’t in your application),
ECDC will not be able to disclose any document at all containing personal
data.
We look forward to your reply. In the meantime we suspend the 15 working
days deadline to reply to your application. ECDC will resume the
processing (and the running of the time limit for our reply) as soon as we
receive your feedback on this issue.
